Q&A: Developments in Tunisia

The following is a translation from Arabic.

Certain recent events in Tunisia raise question mark as to whether the country is headed for a change? Some of these events are:

- The Tunis media, and especially the ‘Tunis News’ and ‘Al-Wasat-at-Tunisiyyah’ have carried news indicating that Zine El Abidine is suffering from prostate cancer and there are no hopes of a cure. He is also reported to have traveled secretly to Europe for treatment.

- In August 2005, a Tunisian diplomat Kamel Morjane, who was working with the United Nations High Commission for Refugees (UNHCR), was appointed to head the Tunisian Defence Ministry. Soon after having taken charge as the MoD, Morjane began a fast-paced diplomatic campaign during which he concluded some very important agreements with the United States.

- In February 2006 the Donald Rumsfeld visited North African Arab countries including Tunisia, and Kamel Morjane reciprocated with his trip to the US later during the same year.

- In 2007, Nicholas Sarkozy, the new French President who is known to be close to the US, visited the region- this was his first trip outside Europe as president.

- In the month of July last, a delegation of US Congress paid visit to Tunisia.

- In late last July, a group of leaders belonging to the Tunisian An-Nahdhah Movement were set free.

- Recently, the US Deputy Chief of Staff Admiral Edmund P. Giambastiani, Jr. visited Tunisia last week and met with senior Tunisian officials, later a delegation of US officers followed his visit to Tunisia.

Does all this indicate that America has started to take a foothold in Tunisia?


In order to clarify, we would remind you of the following:

1-Tunisia is one of the chosen areas of conflict among the colonial powers. This is due to its strategic location as well as its other unique features, it is considered to be a political laboratory for the Western States. It was under the British colonial rule and before that the French had colonised Tunisia militarily.

Having removed Habib Bourguiba in 1987 for being of an advanced age and unable to carry out the duties of governance, Zine El Abidine Ben Ali, who succeeded Bourguiba, followed his predecessor’s policies and remained consistently loyal to the British.

2-America exploited the tense relationship between Tunisia and Libya and in 1988 attempted to exert pressure against Zine El Abidine as well as tempted him in order to gain a foothold in Tunisia. The US provided him generous military aid of $ 61 million under the “Deter Aggression” programme. This was intended to lure Tunisia to support US against Col. Gaddafi and his Libyan regime by forming a front with the US. But Zine El Abidine Ben Ali quickly understood the game-plan and reversed his stand to improve his relations with the Libyan leader. The American reaction at this point was to curtail its aid to a paltry $ 8 million. Thus, America did not succeed in diverting Zine El Abidine’s loyalty from Britain to itself and Zine El Abidine remained loyal to Britain like his predecessor Bourguiba.

3-American has made several efforts and in December 1994 through the so-called "Mediterranean Dialogue" under the auspices of the North Atlantic Treaty Organisation (NATO), which became very effective in the aftermath of the Soviet Union’s collapse. It may be pointed out that this “Dialogue” also included Algeria, Egypt, the state of the Jews, Jordan, Mauritania, Morocco and Tunisia; this is despite the fact that these are not member countries of NATO.

4-The European Union, on its part organized a conference of countries comprising the EU countries, the littoral states of the Mediterranean Sea, i.e. Algeria, Egypt, the Jews’ state, Jordan, Lebanon, Morocco, Syria, Tunisia, Turkey, the Palestinian Authority. This was named as the “Euro Med” project and the meeting was held in Barcelona in November 1995. The European Union has been spent € 9 Billion on this project during the 1995-2000 period. As a result an alliance of 5 southern European countries (France, Italy, Spain, Portugal, Malta) and the five countries of North Africa (Algeria, Morocco, Tunisia, Libya, Mauritania), has emerged and is being called as the group of 5+5. This alliance has focused its efforts to fight against terrorism and illegal immigration. This is with aim of preventing the US from regaining any foothold of influence in the region again, currently this region accounts for a mere 2% of US foreign trade and less than 1% of its foreign investments.

5 - During this period Zine El Abidine’s regime managed to frustrate former American President Clinton’s attempt to penetrate Tunisia in 1995. The then Deputy Secretary of State Belletro visited Tunis in an attempt to integrate Tunisia in the American security plan for North Africa.

6-In 2000 when there was a change of guard in the American administration, its focused sharply towards the region, and pressurised the countries of the region top carry out a set of reforms. This was under the “Greater Middle East project”, yet the US has not been able to boast of any tangible results.

7 - The first success for America in the penetrating Tunisian security’s impregnable fortress was in the aftermath of the 9/11 attacks in the US. It was then that the talk about having US military bases became quite well-accepted. The ‘Wall Street Journal’ on 10 June 2003 published a report quoting officials at the Ministry of Defence regarding the possibility of setting up of semi-permanent military bases in Tunisia, Algeria, Morocco, in the framework of proposed large-scale re-organisation for American forces, including plans for reducing the number of American forces stationed in Germany and moving them elsewhere.

The overseas opposition to the Tunisian regime insist that the American base in the region of Bizerte planned to be built in Siidi Ahmed to used as Airbase, while the other at Bahatar to be used as a naval base.

Tunisia has been participating in recent years in the meetings of a security patrol with the rest of North African countries and the United States, their stated goal is to fight terrorism and to pursue Al-Qaeda fighters in North Africa.

The United States has been using pressure tactics on Tunisia to seek its support in Iraq. On December 30, 2003, the American Council on Foreign Relations issued a report titled (Sanctuaries of Terrorism: Africa) in which Tunisia is included along with Egypt and Algeria among the States that represent a medium-term threat of terrorist activity threats.

Visits by the Congress and American officials during the last couple of years is within this context and are aimed as the ‘Carrot & Stick’ policy of pressure and incentive to cooperate with the US to enable it to gain a foothold in Tunisia.

However, such American pressure did not succeed in dragging Tunisia to go along the US, in fact these American moves are no match for the British policy of ‘no visible confrontation’ with America, though it continues to frustrate American efforts from behind the scenes.

The British are fully aware of America’s interest in Tunis as well as the entire North Africa. Just as the British arranged the transfer of power from Bourguiba to Zine El Abidine, who was allied to them, similarly they are now working to arrange the transfer of power to a successor to Zine El Abidine who can be trusted to follow in his footsteps. At the same time they are keen to present this succession as neither pro nor anti-American. The British thus hope to pre-empt any mounting American pressure on Tunisia. It is with this view that the British choice has fallen on Kamal Morjane in order to soften the Americans since Morjane is seen as more acceptable for America than Zine El Abidine. It must be remembered that Zine El Abidine’s ailment is not exactly terminal and he may survive to complete his tern in office which is until 2009. But by projecting Morjane as the future leader, they aim to calm the Americans and thus ease pressure. This is the British’s conventional tactic to retain influence in a country where there is pressure from other sources. This is similar to what they did in Libya in order to sustain the Libyan regime in the face of mounting US pressure. The British simply appeared to cave in and indicated that they would stop arming Libya, pave way for surrendering the accused in the Lockerbie trial and paying for the damages and claims pertaining to the case. All of this was designed to preempt American arguments to continue pressure on Qaddafi, or at least ease the tension.

Thus projecting Morjane as the successor to the ailing Zine El Abidine who does not have much time left, especially since the British sources have exaggerated his ill-health as we he were terminally ill. As mentioned earlier, this is designed to calm the Americans that Morjane is on his way to power. To understand this aspect well, let us recollect some information on Kamal Morjane, who is currently at the Ministry of Defence:

1. Kamal Morjane is a proficient diplomat.

2. Despite being very a familiar and known face as a result of foreign assignments that he has held, his role as a member of the ruling party is largely unknown.

3. He is closely linked to the current Head of State Zine El Abidine Ben Ali, both from the city of Hamam Sousse, and Morjane’s wife is the daughter of Zine El Abidine’s brother-in-law. Zine El Abidine’s reputation is that of a fox and it is due to his trust in Morjane that the post of Defence Minister is given to him.

4. By virtue of holding external posts for long years, Morjane has earned the respect of the international community and carved a niche for himself.

5. Due to his being away from the internal politics of Tunisia, his name is not linked to the crimes committed by the Tunisian regime against the state and its people, even though he has defended Tunisia during his speeches at the international for a, especially the UN. Thus he is seen to be more acceptable in the global context as well as in Tunisia itself.

Thus, it is likely that he will be more acceptable to the Americans.

It has been observed recently that Kamal Morjane will do everything in his power and use every means available to him to promote himself before the forces to whom he may not be acceptable despite or because of his experience, international standing and internal influence. The political campaign launched by Kamal Morjane is full of reassuring messages about his person, and that he would not act against the international community and especially American interests, hoping thus to be able to neutralize the United States from actions against him or obstructing him.

This was about Kamal Morjane, as for Sarkozy, who undertook his first state visit out the EU to the North African Arab region, the expected change in the Tunisian leadership was not prominent. The visit was basically focused on to the "Mediterranean Partnership", so much so that Morocco refused to receive Sarkozy without any explicable reasons. It is more likely that his visit was more for strengthening France’s cultural influence in the region than for exercising any political pressure on Tunisia. This visit was in the framework of his visits to the regions of British influence and it appears to have been coordinated with them as such. To this extent, Sarkozy’s visit to Tunisia was similar to his earlier visit to Libya.

As for the release of 21 political detainees at the end of last July following Sarkozy’s talks during his visit to Tunisia on Human rights and political prisoners, these detainees were released on the 50th anniversary of the founding of the Republic of Tunisia, and are not related to Sarkozy’s visit as such. Such gestures were more for the purpose of political expediency and in tune with American calls respecting human rights and democratic reform than having any relation to Sarkozy’s visit. There is an exception though and it is that of the release Mohamed Abbou, a known defender of human rights champion. Sarkozy is known to have discussed his case during his meeting Zine El Abidine Ben Ali. As for the other twenty released are understood to be belonging to the an-Nahda Movement. They were let off despite the restrictions placed on them by the Tunisian Ministry of Justice.

In conclusion; we can say that Kamal Morjane was brought to the Ministry of Defense earlier under instructions from the British, to calm American pressure on the regime in Tunisia and thus be prepared to take up the presidency when the need arises without any internal or external surprises. It is like cooking for the banquet on slow fire.

In the end, we could conclude that the ensuing reforms in Tunisia are likely to be in tune with the American desires if not entirely to their taste. As also are the corrective measures with regard to the human rights issues etc... And so on. But at the same time it will be rather premature to assert that America has succeeded in finding a foothold or is on the verge of establishing its influence there. Tunisia is still firmly loyal to the British and the Europeans, its’ security wall is intact and is resisting US attempts at penetrating it, and as long as the military and security services in state are able to control the situation under the leadership of the pro-British politicians, the wall will resist American attempts.

The Masajid, the houses of Allah (swt)

‘The mosques of Allah shall be visited and maintained by such as who believe in Allah and the Last Day, who establish regular prayers and pay the zakat and fear none but Allah. It is they who are on the true guidance’ (Surah Tauba 9:18)

Indeed the Masajids are the houses of Allah (swt), where His (swt) name deserves mention, be Glorified and Praised as Allah says…

‘Those who turn to Allah in repentance, who worship Him, who praise Him, who fast, who bow down in prayer, who prostate themselves…’ (Surah Tauba 9:112)

And they are the places where his name is mentioned through the day and through the night as Allah says

‘In houses (mosques) which Allah has ordered to be raised , in them His name is remembered. Therein glorify Allah in the mornings and in the afternoons or the evenings.’ (Surah An Noor 24:36)

Then who would miss the visit to be the guest of the Lord of the Worlds and seek his protection.

Abu Huraira narrated that the Prophet said ‘The reward of the prayer offered by a person in congregation is multiplied 25 times as much as that of the salat offered in one’s house or in the market alone. And this is because if he performs wudu and does it perfectly and then proceeds to the mosque , with the sole intention of praying , then for every step he takes towards the mosque he is upgraded one degree in reward and one of his sins is taken off from his accounts. When he offers his salat , the angels keep on asking Allah’s blessings and Allah’s forgiveness for him as long as he he is at his Musalla (place of prayer) .They say ‘O Allah ! Bestow your blessings upon him, be merciful and kind to him. And one is regarded in salat as long as one is waiting for the Salat. [Bukhari]

Sa’id ibn al Musayyab was asked ‘Which do you prefer , attending a Janaza or sitting in the Mosque ?’He replied , ‘Whoever prays the Janaza has one qirat, whoever is present at the burial has 2 qirats. I prefer sitting in the mosque because the angels say , O Allah , forgive him! O Allah , show mercy to him! O Allah turn to him’

Dear Brothers, know that the angels will ask for your protection and for Allah’s mercy to descend upon you when you visit His houses.

Anas ibn Malik related from the Messenger (saw) who said ‘Whoever Allah loves should love me. Whoever loves me should love the Sahaba . Whoever loves the Sahaba should love the Quran. Whoever loves the Quran should love the mosques, for they are the courtyards of Allah which were built with the permission of Allah that they be raised up and He has blessed them what is in them. It’s people are blessed and it’s people are protected while they are in their prayers. Allah is seeing to their needs while they are in their mosques and Allah is before them.

The rewards for those who visit the mosques, set off to the mosques or intend to visit the mosques are abundant and very few deeds would match in their status and it would be hard to compensate for them if we missed them.

It is related from Abu Umama that Rasool (saw) said ‘Whoever leaves his house in a state of purity for a prescribed prayer has the reward of the Hajji in his ihram’

The Prophet said, "The people who get tremendous reward for the prayer are those who are farthest away (from the mosque) and then those who are next farthest and so on. Similarly one who waits to pray with the Imam has greater reward than one who prays and goes to bed. " [Bukhari]

AbuHurayrah narrated that Allah's Messenger (peace be upon him) said: “As you happen to pass by the `gardens of Paradise', relish their fruits. It was said: Allah's Messenger, what are the gardens of Paradise. He said: Mosques.” [Transmitted by Tirmidhi saying this is a hasan gharib hadith]

Burayda said that the Prophet (saw) said ‘Give the good news to those who walk in the darkness to the mosques of complete light on the Day of Rising’

So brothers, do not fear the darkness of the night walking to the mosques for Isha or the Fajr salat as Allah will never fail you in your strides and your breaths but fear Him who will illuminate you on that Day when it will count as He (saw) also said ‘If anyone goes to the mosque in the morning or the evening, Allah will prepare for him hospitality in the Garden’.

Abu Huraira narrated that the Prophet said, "No prayer is harder for the hypocrites than the Fajr and the 'Isha' prayers and if they knew the reward for these prayers at their respective times, they would certainly present themselves (in the mosques) even if they had to crawl." [Bukhari]

Brothers when on a journey or far from a masjid and the time for prayer comes Allah (swt) in His mercy has made the entire world a masjid for us. As Muhammed (saw) said, ‘I have been given 5 things which were not given to any amongst the Prophets before me. These are Allah made me victorious by awe (by frightening my enemies) for a distance of one months journey, the earth has been made for me (and my followers) a place for praying and a thing to perform Tayammum, therefore my followers can pray wherever the time of a prayer is due…’ [narrated by Jabir bin Abdullah in Bukhari]

You should know - may Allah have mercy upon you - that when the slave of Allah leaves his house to go to the mosque that he is going to face Allah, the Irresistable , the One, the Omnipotent and the Exalted in Might in the knowledge that nothing is hidden from Him and that even something as small as the a mustard seed is not concealed from Him nor even something smaller or larger in the earth or in the heavens, in the seas or the lofty mountains.

When anyone from amongst you sets out from his home for the mosque he should remind himself of words of remembrance, being calm, somberly for this is what the Prophet (saw) ordered us to do, he should set out with his heart full of longing and desire for Allah (azzaw ajjals) pleasure and fear and apprehension of His anger and with humility and meekness towards Allah. For the more humble , the more meek , the more submissive he is to Allah , the more virtuous he becomes in his Salah , the greater becomes his reward and the more noble and nearer to Allah becomes the slave. But should he be filled with pride Allah will destroy him and will reject his deeds for the proud are never accepted. So be humble in each Salat as He is the one who you stand in front of day and night that bestows blessings , provides abundant favours and removes hardships when he wishes though we come with sins.

AbuSa'id al-Khudri narrated that Allah's Messenger (peace be upon him) said: “When you see a person coming to the mosque frequently, bear witness to his faith, for Allah says: `Only who affirms his faith in Allah and the Last Day, can maintain the mosques of Allah.” (9:18) [Transmitted by Tirmidhi Ibn Majah and Darimi]

The masajids , being the houses of Allah have an honourable status and Islam gave the Sharia rules relating to them just as it has with Jihad, marriage, ruling, hajj or parenthood. Rasool (saw) was asked, “What deeds are best? He (saw) said to perform the salat at their (early) stated fixed times, to be good and dutiful to one’s own parents and to participate in Jihad feesabeelillah”. [Bukhari]

Living in age when the salah is not established in the society even in the Islamic lands, where the one who does not pray is not punished, in this age even if those smitten by the Kufr culture find the regular performance of Salah as strange, this should never deter those who believe in Allah and surrender to his Ahkaam (laws) especially those who are young and in their youth, motivated with the pure Islam and seek shelter in Allah’s shade as Bukhari reported that Abu Huraira narrated that the Prophet (saw) said, ‘Seven people will be shaded by Allah under His shade on that Day when there will be no shade except His. They are 1) A just ruler 2) a young man who has been brought up in the worship of Allah 3) A man whose heart is attached to the mosques…’

Dear brothers, the shade of Allah on that Day will be the residence of security averted from the blazes of fire of Jahannum and who would wish to be bare, unshielded and exposed when His punishment will be the most severe.

Let your entry to the houses of Allah be frequent during the day entering with the right foot and reciting the Dua that we have been recommended that is reported in Ibn Majah and Imam Ahmed…..

‘Bismillah wassalaam ala Rasool Allah. Allah humag-fir li dhanoobi waftah li abwab rahmaatik’
“In the name of Allah and peace be upon the Messenger of Allah . Forgive my sins and open for me the gates of Your mercy”

And make the exit be as honourable stepping out with the left foot and reciting ….

‘Bismillah wassalam ala Rasool Allah. Allah humagfir li dhanoobi waftah li abwab fadhlik’
“In the name of Allah and peace be upon the Messenger of Allah . Forgive my sins and open for me the gates of Your blessings”

As for the superiority of building the mosques and aiding in their construction just as Rasool (saw) built the mosque with his own hands with the help of the Sahaba the Prophet himself mentioned in a narration by Ubaidullah Al-Khaulani who heard Uthman ibn Affan … ’’Whoever built a mosque with the intention of seeking Allah’s pleasure Allah will build for him a similar place in Paradise’ (Bukhari).

Abu Hurayrah narrated that Allah's Messenger (peace be upon him) said: “Verily what a believer continues to receive (in the form of reward) for his action and his virtues after his death is the knowledge which he acquired and then disseminated, the pious son that he left behind him, or a copy of the Qur'an which he left as a legacy, or the mosques that he had built, or the inn that he had built for the wayfarers, or the canal that he caused to flow, or a sadaqah which he gave out of his property in the state when he was healthy and alive. (These are the acts of goodness the reward of which) reaches him even after his death.” [Transmitted by Ibn Majah, Bayhaqi in Shu'ab al-Iman]

And what can be said about the Jummah Salaah and its preparation, being the most noted of the Salat in the week, a time of joy and a gathering in the Masjid as Allah (swt) ordered it in the Quran in Surat Al Jumma where He said…


‘When the call is proclaimed for the Prayer on the day of Friday , come to the remembrance of Allah and leave off business….’ (Surah Al Jumma 62:9 )

That is the time when all will gather enjoying the collective spirit of the community attending from far and wide or those who are the neighbours to the mosque striving to attain their place in the earlier saffs (rows) as Bukhari reported from Abu Haraira that the Prophet (saw) said, ‘When it is a Friday the angels stand at the gate of the mosque and keep on writing the names of the persons coming to the mosque in succession according to their arrivals.’ [Bukhari]

"Any person who takes a bath on Friday like the bath of Janaba and then goes for the prayer (in the first hour i.e. early), it is as if he had sacrificed a camel (in Allah's cause); and whoever goes in the second hour it is as if he had sacrificed a cow; and whoever goes in the third hour, then it is as if he had sacrificed a horned ram; and if one goes in the fourth hour, then it is as if he had sacrificed a hen; and whoever goes in the fifth hour then it is as if he had offered an egg. When the Imam comes out (i.e. starts delivering the Khutba), the angels present themselves to listen to the Khutba." [reported by Abu Huraira, Bukhari]

Those are the days which will add to the reward, eagerly leaving our homes, businesses, workplaces or whatever that will prevent us from the remembrance of Allah, coming purified to attain solely His pleasure. Salman Al Farsi reported from the Prophet (saw) who said ‘Whoever takes a bath on Friday , purifies himself with the scent of his house, then proceeds for Jumma and does not separate two people sitting together ( in the mosque), then prays as much as (Allah has) written for him and then remains silent while the Imam is delivering the khutba , his sins in between the present and the last Friday would be forgiven’ [Bukhari]

About this day we have been informed of a particular time which is one of the times that our Dua will be accepted as the Prophet (saw) mentioned about the Friday prayer and said ‘there is an hour on Friday and if a Muslim gets it while praying and asks something from Allah Ta’ala then Allah will definitely meet his demand’ (Bukhari on the authority of Abu Huraira)

So meet altogether, be it with your families and friends, your neighbours and your relations and struggle to achieve what Islam has demanded from you as best as you can.

Dear Brothers this is how Allah views our actions towards the mosque and this is how the sharia has defined your responsibility. The true believer could not separate himself from the house of Allah where he would seek solace, forgiveness, repent and call to the words of Haq. His heart would naturally be attached to the Masajids and his love would never diminish as Muhammed (saw) said ‘Be like the guests in this world and take the mosques as houses…..’ indicating to preserve and protecting them, guarding them and being in their surroundings. They are the very places which our honourable Sahaba witnessed the playing with the spears, sweeping its area, tying the prisoner of war and holding the heads of their arrows in the mosque. The mosque was where the Prophet (saw) pitched a tent to look after Sa’d ibn Muadh as he was wounded in the battle of Khandaq, that is where the banning of alcoholic drinks was issued when he recited the verses of Surah al Baqara, it was here that He (saw) sat with the Sahaba and recollected poetry and provided Hassan with the pulpit where he would lampoon the Disbelievers (Al Tirmidhi). This was where the Prophet (saw) distributed the war booty as well as enjoying a rest and sleep as a traveler, it was where he catered for the Ahl ul Saffah and ordered the azaan for Jihad.

So remember what has been spoken of as most men know not, make them the centres of your meeting places, gatherings and places of prayer, let your fathers and sons, your brothers and relatives join you in those places of security. Abu Darda had said to his son ‘Let the mosque be your house for I heard the Messenger of Allah say, ‘The mosques are the houses of those who have fear of Allah.’

Only the Khilafah will end colonialist exploitation

بِسْمِ الله الرَّحمَنِ الرَحيم

On 13 September 2007, during the visit of US Deputy Secretary of State, John Negroponte, President General Pervez Musharraf emphatically denied any dictation from America in Pakistan’s affairs. On state television, Musharraf claimed, “No one is dictating to us ... We are taking action in the national interest.” Musharraf further added that Pakistan is a strong Muslim country, saying, “We are not weak. We have stature in the region and in the Ummah. We are a nuclear and missile power [with a population] of 160 million.”

However, since 12 October 1999 until now, Musharraf has consistently used Pakistan’s many strengths to secure colonialist interests, despite dire consequences for the Muslims of Pakistan. Moreover, the current wrangling over ruling- involving supreme-court proceedings over Musharraf’s election as a President, deportations of politicians, briefings between politicians of all colors with the British and the Americans- will surely prolong subservience to the colonialists, regardless of its outcome in terms of changes of faces. This was an inevitable matter because the current system is inherently designed to secure the interests of the colonialists, regardless of whether the ruler is civilian or military, dictator or democrat, inclined to the Americans or the British.

The present system has ensured that over the last eight years, the affairs of Muslims have worsened so that the colonialists may prevail over them. This is despite changes of faces through elected assemblies and prime ministers. This is also despite the presence of those who call for the implementation of Islam through the present system.

Through the present system, America secured the use of Pakistan’s airbases to enable it to viciously bomb Afghanistan, preparing the ground for an invasion and occupation. Then when America’s occupying forces faced fierce resistance from the Muslims of the tribal areas, America was able to ensure that Pakistan’s soldiers fought their own Muslim brothers, creating chaos and an atmosphere of fear throughout Pakistan. With its army, the world’s seventh largest, engaged in a disruptive conflict within its own borders, Pakistan now becomes less of a threat to America.
Also, through the present system, America ensured that the Muslims of Kashmir were abandoned before the brutal Indian aggressors. Jihad against the Hindu occupying forces was declared a crime. Now, the Muslims of Kashmir and Pakistan are to concede to Hindu injustice and supremacy, in spite of the fact that Muslims as a minority ruled by the light of Islam over the whole of the Indian Subcontinent for hundreds of years.

And through the present system, America is seeking to prevent the Ummah’s relentless return to Islam. The Americans are deeply concerned about the growth of Islam. On 28 February 2006, Negroponte, Director of National Intelligence at the time, testified to the Senate Armed Services Committee, “In general, Muslims are becoming more aware of their Islamic identity, leading to growing political activism…” America fears that Islamic revival will naturally lead to the political change that is required in the Muslim World- the uprooting of the colonialist system and the re-establishment of the Khilafah- as has been mentioned repeatedly by both British and American government officials.

Fearing the demise of the system that has served them so well for so long, America hopes to deceive the Muslims by making a cosmetic, artificial change by changing the faces in the present system through elections. On 12 September 2007, Negroponte said, “We look forward to democratic elections being held in Pakistan quite shortly and we think it is quite important that there be a smooth and democratic political transition.”

The Americans hope that the change in faces will vent some of the anger of the people, whilst allowing the colonialist system to continue. And the Americans consider this as a matter of vital importance and this is why the US government has invested millions of dollars in Pakistan’s system and has been active in meeting Pakistan’s politicians, rulers and assembly members.

It is inevitable that the present system will always secure the interests of the colonialists, regardless of who comes to rule within it, whether by elections or coup. The fundamental basis of the present system is that man should be the one to decide the Halaal and Haraam, the good and bad i.e. man should place himself in the position of Legislator instead of Allah سبحانه وتعالى. The colonialists are then able to ensure that both the rulers and the assemblies make laws according to their interests.

Whilst Islam stipulates that the ruler is elected by choice and consent and it stands against the one who usurps the authority, Islam denies both the elected Khaleefah and the elected members of the Majlis-e-Ummah the right to decide what is Halal and what is Haram for themselves as occurs in democracy and dictatorship. And Allah سبحانه وتعالى revealed,

وَمَنْ لَمْ يَحْكُمْ بِمَا أَنزَلَ اللَّهُ فَأُوْلَئِكَ هُمْ الظَّالِمُونَ
“Those who do not judge by the law which Allah has revealed, they are the oppressors.” [Surah Al-Maidah 5:45]

And Allah سبحانه وتعالى revealed,

وَمَا آتَاكُمْ الرَّسُولُ فَخُذُوهُ وَمَا نَهَاكُمْ عَنْهُ فَانْتَهُوا وَاتَّقُوا اللَّهَ إِنَّ اللَّهَ شَدِيدُ الْعِقَاب
“So take what RasulAllah assigns to you and deny yourselves that which he withholds from you. And fear Allah; for Allah is strict in Punishment.” [Surah Al-Hashr 59:7]

O Muslims of Pakistan!

RasulAllah صلى الله عليه وسلم warned the Muslims,

لَا يُلْدَغُ الْمُؤْمِنُ مِنْ جُحْرٍ وَاحِدٍ مَرَّتَيْنِ
“A believer is never stung from the same whole twice.” (Bukhari)

Without doubt the Muslims of Pakistan have not been stung twice, but countless times from the present system for over sixty years. It is high time that you forsook the present system that allows rulers to rule over you by a constitution and laws based on Kufr, whether dictatorship or democracy, and liberate yourselves from the clutches of the Kafir colonialists. That can only happen by establishing a Khilafah state and by electing a Khaleefah to rule and representatives of the Majlis-e-Ummah to provide consultation and accounting. Only then the strength of the Muslims will be used to liberate them from the oppression of the colonialists through the implementation of Islam.

يَاأَيُّهَا الَّذِينَ ءَامَنُوا اسْتَجِيبُوا لِلَّهِ وَلِلرَّسُولِ إِذَا دَعَاكُمْ لِمَا يُحْيِيكُمْ
“O you who believe! Give your response to Allah and His Messenger, when He calls you to that which gives you life.” (Surah Anfal 8:24)

Towards a New world order

If asked to give a single word that describes the prevailing world scene; the answer in most cases will be - Unrest. If asked the cause or reason behind it; the answer would be - Materialism. Sorry! The answer is wrong. These are merely the symptoms of the ailment called Shirk and the cause is the absence of Khilafah.

True, that the unabashed pursuit of wealth by individuals and nations is the key behind the all pervasive unrest. This pursuit has been triggered because some nations are rich in natural wealth (such as Middle-East, India etc.) while others are poor (such as Europe, USA etc.). Incidentally, the poorer ones are consuming more while producing less. To make their ends meet, the poorer grab it by hook or crook from the rich. Creating an atmosphere of chaos is conducive for the poorer nations as they can plunder without being noticed.

In the years that followed after the passing away of the Rasool Allah (SAW), the Islamic world made unparalleled progress in science, literature, astronomy, mathematics, trade, commerce and political annexation of territories. The bulwark behind this tremendous progress was the strong foundation of Aqeedah in the Muslims laid by Rasool Allah (SWA). This brilliant era continued for more than a millennium. Then came the decline until it was vanquished in March 1924 CE.

Note that the past 83 years (since 1924) have been the playfield of one holocaust after another, one mischief succeeding the other. Oh You Muslims! Take your share of blame. If you would have had a Khalifah today, you would have saved the world from this chaos and in the process of course saved yourself from the disgrace that you face today.

Now, is it possible to once again unify the world under one Allah-fearing ruler? Can Khilafah be re-established on this earth again? YES. Khilafah can surely be re-established but the asking is tough. Can you give up the 'love of this world' and the 'fear of death'? The companions of the Prophet (RA) did it in ample measure and gave the world an unbroken string of Khalifah for 1344 years.

Count our strength:

(i) Most of the Muslims today admit that the rule of Shariah must prevail in their lives - i.e. they must be governed by the Shariah law. This is not possible till we again have an Islamic State with a Khalifah as the unifying head.

(ii) There is a very large population of Muslims spread out all over the world who would form the unflinching subjects of the Khilafat.

(iii) Natural resources are abound in most Muslim countries, which appreciate in value with passage of time. This can act as the material strength of the Khilafat.

(iv) Most Kafir countries have little natural wealth as compared to their industrial or manufactured wealth, which loses value with the passage of time. These countries depend even today upon Muslim countries for the basic raw materials. With the advent of Khilafat, the economies of Kuffar will crumble. Moreover the economies of Kuffar is based on exploitation and hence destined to fail.

(v) Armies of most Muslim countries have faith in Allah and are mentally ready to support a Khalifah. A political change of their corrupt heads-of-state would make them the 'Army of Allah'.

(vi) Armies of most Kafir countries are immoral i.e. drowning in wine and women and are disloyal or at least unconcerned about the goals of their leaders.

(vii) By falsely targeting Muslims today and projecting wrong information as true, the intelligence agencies have left themselves and their Kuffar countries directionless and bewildered.

(viii) Allah will support the Muslim armies with His angels and simultaneously instill fear in the hearts of the Kuffar.

Our weaknesses are:

(i) Our Aqeedah (foundations of Belief in Allah) have weakened. We need to refresh and live by them.

(ii) We have been made to believe by the Kuffar that Khilafah is a primitive concept and not in keeping with the modern times. We must believe that it is indeed the most modern and just form of governance.

(iii) We have accepted the wrong verdict of the Kuffar that Islam does not have a ruling system. The fact is that Islam has a very elaborate ruling system - Administrative, Executive and Judiciary. We have a perfect system for tax collection & distribution of wealth, revenue collection & expenditure of the State, judicial & law enforcement, interpretation & application of Shariah laws to daily life, education policy & propagation of Islam, foreign policy, collection & dissemination of information - name it and we have it. Yes! We do not have a Legislature to make and unmake laws because our laws are made by Allah (SWT) who knows our future needs and therefore He made perfect and immutable rules for all times and all people.

So, Muslim brothers and sisters of the world, awake, rise and stop not till the Khilafah is established.

Indian Intelligence informer spills the beans

The following is an interesting story from the Times of India newpaper on 22nd September 2007:

Jailed ‘militant’ urges PM to intervene , Days After CBI ‘Clean Chit’, Still In Tihar

New Delhi: Languishing in Tihar Jail for the past 18 months, even after the CBI stated in Delhi High Court in July this year that the Delhi Police probe against them ‘‘did not inspire confidence’’, one of the two alleged Al Badr terrorists has decided to speak out. Immediately after a report appeared in this paper on September 13 about the two accused, Irshad Ali and Mohammed Qamar, Ali wrote a letter to an Urdu daily and his relatives, asking them to send a copy of the letter to this paper.

Urging the prime minister to step in, Ali in the letter describes how the two of them were falsely implicated by the special cell of Delhi Police and, in another setback for the cops, also provides the numbers of mobile phones which were provided to him by the police and IB to work as their informers. Ali says he provided information to police and IB officers on these phones and pleads that these numbers be scrutinized to ‘‘dig out the truth’’.

The CBI status report, which pointed to at least seven major loopholes in the police investigations, was first reported by this paper on July 17. In a follow-up on September 13 (‘IB, Cops in Murky Frame Up’), which is referred to by Ali in the letter, it was revealed that IB officials had actively participated in the operation. IB officer Majid Din’s name also figures in the letter and his phone number mentioned is the same as the one in CBI’s report.

The other officials, who have been named in the letter, and with whom he had regular interaction as informer, include ACP Sanjeev Yadav, inspectors Hriday Bhushan, Lalit Mohan Negi and Aftab, who works with IB. To their credit, Bhushan and Negi appeared before the CBI and accepted that Ali and Qamar were their informers and that they were not a part of the operation to arrest the two men. The special cell held a press conference after their arrest and claimed the two were terrorists and that 2 kg RDX had been seized from them.

Yadav, however, filed a report in the high court saying that the operation was genuine even after the court ordered a CBI probe into their arrests.

Ali, however, goes on express apprehension about the CBI probe and says that he wasn’t sure if the CBI would ensure punishment for the culprits. He clearly fears that the CBI, being a government agency, would finally bail out the cops under scanner. He says the two men have identified the place where they were illegally detained for two months, but the CBI had not put this on record. As an insider, and somebody who helped police nab terrorists and criminals in the past, he also describes the modus operandi of the special cell for framing innocent people. Joint commissioner of police (special cell) Karnal Singh, however, said these were allegations and that he did not want to comment because the matter is pending in the high court.

Special Cell Is A Group Of Licensed Marauders, Writes ‘Informer’ Irshad Ali

I am writing this letter from Tihar Jail with the aim of saving innocent youths from getting trapped by unscrupulous security officials. My name is Irshad Ali, s/o Mohammad Yunus, incarcerated in ward no. 5 (high risk ward), cell no. 13 in jail no. 8 of Delhi’s Tihar Jail.

Many of you may have read my story in The Times of India dated September 13, 2007 citing a CBI report confirming that IB and Special Cell of Delhi Police had framed us. But I doubt if the CBI will nail the actual culprits.

I was working as an informer for the Special Cell of Delhi Police, which works closely with the IB. Having worked with them, I feel duty bound to apprise the nation of how they manufacture terrorists. Have you ever noticed how quick our agencies are in nabbing the culprits even before they strike? But how they still have not yet been able to lay their hands on any terrorist involved in the Mumbai and Delhi blasts?

I have the answers.

In order to keep their ranks and earn rewards, Special Cell creates terrorists. They have employed a number of youths on a very paltry remuneration. They are not regular employees, but vagabonds who are given mobile phones and protection. They are asked to fan out and hire accommodation somewhere in the city. They mingle with unemployed youth and befriend people. After identifying vulnerable targets, they form a group, arrange weapons and incite these youth to go for a robbery. Special Cell secretly also provides them a stolen vehicle, which is procured from known car thieves.

These youths who vest all their trust in the Special Cell agent finally one day decide to go for an operation. On reaching the target, they are trapped in the net. The police are already there and they are all nabbed. Interestingly, the agent, who is also a mastermind is never caught.

Medals and bravery awards follow. The Intelligence Bureau (IB) feeds the government and media with concocted stories. Have you noticed that those killed in encounters are invariably found carrying details like their names, rank in the organisation etc in their pockets? They die without firing a bullet and even if they fire, it never hits the target. Compare it with the Army’s encounters with real terrorists in Kashmir. In almost every battle, one or two personnel get bullet wounds. Either our Army is not as trained as the Special Cell of Delhi Police, or these encounters are fake.

The Special Cell is a group of licensed marauders. They are venomous against Muslims. My only fault was that I refused to go along with them for too long. They know in the name of Islamic terrorism, you can book anyone, plant explosives, give the name of some organisation and get away with it. I am pained to say, our courts too fall in line.

I was in their confinement for over two months. After my father lodged a complaint in the local police station and the family of my co-accused, Nawab S/o Qamar, gave a look out notice on TV, they produced us claiming we had been nabbed with explosives while returning after a two-month training. We challenged it in the high court, which later directed the CBI to inquire. CBI has submitted its preliminary report. I don’t think they will go too far to book their cousins in the IB and Special Cell. For the past one-and-half years, we have been identifying the place where we had been kept for two months. But they are deliberately not putting it on record.

I appeal to PM Dr Manmohan Singh, to step in and put a stop to such activities.

Tafsir of verses on Ramadhan & Fasting - Part 2

The Virtue of Ramadan and the Revelation of the Qur'an in it.

Allah praised the month of Ramadan out of the other months by choosing it to send down the Glorious Qur'an, just as He did for all of the Divine Books He revealed to the Prophets. Imam Ahmad reported Wathilah bin Al-Asqa` that Allah's Messenger said:

«أُنْزِلَتْ صُحُفُ إِبْرَاهِيمَ فِي أَوَّلِ لَيْلَةٍ مِنْ رَمَضَانَ، وَأُنْزِلَتِ التَّوْرَاةُ لِسِتَ مَضَيْنَ مِنْ رَمَضَانَ، وَالْإِنْجِيلُ لِثَلاثَ عَشَرةَ خَلَتْ مِنْ رَمَضَانَ، وَأَنْزَلَ اللهُ الْقُرْآنَ لأَرْبَعٍ وَعِشْرِينَ خَلَتْ مِنْ رَمَضَان»

(The Suhuf (Pages) of Ibrahim were revealed during the first night of Ramadan. The Torah was revealed during the sixth night of Ramadan. The Injil was revealed during the thirteenth night of Ramadan. Allah revealed the Qur'an on the twenty-fourth night of Ramadan.)

The Virtues of the Qur'an

Allah said:

[هُدًى لِّلنَّاسِ وَبَيِّنَـتٍ مِّنَ الْهُدَى وَالْفُرْقَانِ]

(...a guidance for mankind and clear proofs for the guidance and the criterion (between right and wrong).)

Here Allah praised the Qur'an, which He revealed as guidance for the hearts of those who believe in it and adhere to its commands. Allah said:


(and clear proofs) meaning, as clear and unambiguous signs and unequivocal proof for those who understand them. These proofs testify to the truth of the Qur'an, its guidance, the opposite of misguidance, and how it guides to the straight path, the opposite of the wrong path, and the distinction between the truth and falsehood, and the permissible and the prohibited.

The Obligation of Fasting Ramadan

Allah said:

[فَمَن شَهِدَ مِنكُمُ الشَّهْرَ فَلْيَصُمْهُ]

(So whoever of you sights (the crescent on the first night of) the month (of Ramadan, i.e., is present at his home), he must observe Sawm (fasting) that month.)

This Ayah requires the healthy persons who witness the beginning of the month, while residing in their land, to fast the month. This Ayah abrogated the Ayah that allows a choice of fasting or paying the Fidyah. When Allah ordered fasting, He again mentioned the permission for the ill person and the traveler to break the fast and to fast other days instead as compensation. Allah said:

[وَمَن كَانَ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِّنْ أَيَّامٍ أُخَرَ]

(...and whoever is ill or on a journey, the same number [of days which one did not observe Sawm(fasting) must be made up] from other days.)

This Ayah indicates that ill persons who are unable to fast or fear harm by fasting, and the traveler, are all allowed to break the fast. When one does not fast in this case, he is obliged to fast other days instead. Allah said:

[يُرِيدُ اللَّهُ بِكُمُ الْيُسْرَ وَلاَ يُرِيدُ بِكُمُ الْعُسْرَ]

(Allah intends for you ease, and He does not want to make things difficult for you.)

This Ayah indicates that Allah allowed such persons, out of His mercy and to make matters easy for them, to break the fast when they are ill or traveling, while the fast is still obligatory on the healthy persons who are not traveling.

Several Rulings concerning the Fast

The authentic Sunnah states that Allah's Messenger traveled during the month of Ramadan for the battle for Makkah. The Prophet marched until he reached the area of Kadid and then broke his fast and ordered those who were with him to do likewise. This was recorded in the Two Sahihs. Breaking the fast mentioned in this Hadith was not required, for the Companions used to go out with Allah's Messenger during the month of Ramadan, then, some of them would fast while some of them would not fast and neither category would criticize the others. If the command mentioned in the Hadith required breaking the fast, the Prophet would have criticized those who fasted. Allah's Messenger himself sometimes fasted while traveling. For instance, it is reported in the Two Sahihs that Abu Ad-Darda' said, "We once went with Allah's Messenger during Ramadan while the heat was intense. One of us would place his hand on his head because of the intense heat. Only Allah's Messenger and `Abdullah bin Rawahah were fasting at that time.''

We should state that observing the permission to break the fast while traveling is better, as Allah's Messenger said about fasting while traveling:

«مَنْ أَفْطَرَ فَحَسَنٌ، وَمَنْ صَامَ فَلَا جُنَاحَ عَلَيْه»

(Those who did not fast have done good, and there is no harm for those who fasted.)

In another Hadith, the Prophet said:

«عَلَيْكُمْ بِرُخْصَةِ اللهِ الَّتِي رُخِّصَ لَكُم»

(Hold to Allah's permission that He has granted you.)

Some scholars say that the two actions are the same, as `A'ishah narrated that Hamzah bin `Amr Al-Aslami said, "O Messenger of Allah! I fast a lot, should I fast while traveling'' The Prophet said:

«إِنْ شِئْتَ فَصُمْ، وَإِنْ شِئْتَ فَأَفْطِر»

(Fast if you wish or do not fast if you wish.)

This Hadith is in the Two Sahihs. It was reported that if the fast becomes difficult (while traveling), then breaking the fast is better. Jabir said that Allah's Messenger saw a man who was being shaded (by other people while traveling). The Prophet asked about him and he was told that man was fasting. The Prophet said:

«لَيْسَ مِنَ الْبِرِّ الصِّيَامُ فِي السَّفَر»

(It is not a part of Birr (piety) to fast while traveling.) This was recorded by Al-Bukhari and Muslim.

As for those who ignore the Sunnah and believe in their hearts that breaking the fast while traveling is disliked, they are required to break the fast and are not allowed to fast.

As for making up for missed fasting days, it is not required to be consecutive. One may do so consecutively or not consecutively. There are ample proofs to this fact. We should mention that fasting consecutive days is only required exclusively during Ramadan. After the month of Ramadan, what is required then is to merely make up for missed days. This is why Allah said:

[فَعِدَّةٌ مِّنْ أَيَّامٍ أُخَرَ]

(. ..the same number (should be made up) from other days.)

Ease and not Hardship

Allah then said:

[يُرِيدُ اللَّهُ بِكُمُ الْيُسْرَ وَلاَ يُرِيدُ بِكُمُ الْعُسْرَ]

(Allah intends for you ease, and He does not want to make things difficult for you.)

Imam Ahmad recorded Anas bin Malik saying that Allah's Messenger said:

«يَسِّرُوا وَلَا تُعَسِّرُوا وَسَكِّنُوا وَلَا تُنَفِّرُوا»

(Treat the people with ease and don't be hard on them; give them glad tidings and don't fill them with aversion.)

This Hadith was also collected in the Two Sahihs. It is reported in the Sahihayn that Allah's Messenger said to Mu`adh and Abu Musa when he sent them to Yemen:

«بَشِّرَا وَلَا تُنَفِّرَا، وَيَسِّرَا وَلَا تُعَسِّرَا، وَتَطَاوَعَا وَلَا تَخْتَلِفَا»

(Treat the people with ease and don't be hard on them; give them glad tidings and don't fill them with aversion; and love each other, and don't differ.)

The Sunan and the Musnad compilers recorded that Allah's Messenger said:

«بُعِثْتُ بِالْحَنِيفِيَّةِ السَّمْحَة»

(I was sent with the easy Hanifiyyah (Islamic Monotheism).)

Allah's statement:

[يُرِيدُ اللَّهُ بِكُمُ الْيُسْرَ وَلاَ يُرِيدُ بِكُمُ الْعُسْرَ وَلِتُكْمِلُواْ الْعِدَّةَ]

(Allah intends for you ease, and He does not want to make things difficult for you. (He wants that you) must complete the same number (of days)) means: You were allowed to break the fast while ill, while traveling, and so forth, because Allah wanted to make matters easy for you. He only commanded you to make up for missed days so that you complete the days of one month.

Remembering Allah upon performing the Acts of Worship

Allah's statement:

[وَلِتُكَبِّرُواْ اللَّهَ عَلَى مَا هَدَاكُمْ]

(...and that you must magnify Allah [i.e., to say Takbir (Allahu Akbar: Allah is the Most Great)] for having guided you) means: So that you remember Allah upon finishing the act of worship. This is similar to Allah's statement:

[فَإِذَا قَضَيْتُم مَّنَـسِكَكُمْ فَاذْكُرُواْ اللَّهَ كَذِكْرِكُمْ ءَابَآءَكُمْ أَوْ أَشَدَّ ذِكْرًا]

(So when you have accomplished your Manasik, (rituals) remember Allah as you remember your forefathers or with far more remembrance.) (2:200) and:

[فَإِذَا قُضِيَتِ الصَّلَوةُ فَانتَشِرُواْ فِى الاٌّرْضِ وَابْتَغُواْ مِن فَضْلِ اللَّهِ وَاذْكُرُواْ اللَّهَ كَثِيراً لَّعَلَّكُمْ تُفْلِحُونَ ]

(...Then when the (Jumu`ah) Salah (prayer) is ended, you may disperse through the land, and seek the bounty of Allah (by working), and remember Allah much, that you may be successful.) (62:10) and:

[فَاصْبِرْ عَلَى مَا يَقُولُونَ وَسَبِّحْ بِحَمْدِ رَبِّكَ قَبْلَ طُلُوعِ الشَّمْسِ وَقَبْلَ الْغُرُوبِ - وَمِنَ الَّيْلِ فَسَبِّحْهُ وَأَدْبَـرَ السُّجُودِ ]

(...and glorify the praises of your Lord, before the rising of the sun and before (its) setting. And during a part of the night, glorify His praises, and after the prayers.) (50:39, 40)

This is why the Sunnah encouraged Tasbih (saying Subhan Allah, i.e., all praise is due to Allah), Tahmid (saying Al-Hamdu Lillah, i.e., all the thanks are due to Allah) and Takbir (saying Allahu Akbar, i.e., Allah is the Most Great) after the compulsory prayers. Ibn `Abbas said, "We used to know that Allah's Messenger has finished the prayer by the Takbir.'' Similarly, several scholars have stated that reciting Takbir the during `Id-ul-Fitr was specified by the Ayah that states:

[وَلِتُكْمِلُواْ الْعِدَّةَ وَلِتُكَبِّرُواْ اللَّهَ عَلَى مَا هَدَاكُمْ]

((He wants that you) must complete the same number (of days), and that you must magnify Allah [i.e., to say Takbir (Allahu Akbar: Allah is the Most Great)] for having guided you...) Allah's statement:

[وَلَعَلَّكُمْ تَشْكُرُونَ]

( that you may be grateful to Him.) means: If you adhere to what Allah commanded you, obeying Him by performing the obligations, abandoning the prohibitions and abiding by the set limits, then perhaps you will be among the grateful.

[وَإِذَا سَأَلَكَ عِبَادِي عَنِّي فَإِنِّي قَرِيبٌ أُجِيبُ دَعْوَةَ الدَّاعِ إِذَا دَعَانِ فَلْيَسْتَجِيبُواْ لِى وَلْيُؤْمِنُواْ بِى لَعَلَّهُمْ يَرْشُدُونَ ]

(186. And when My servants ask you (O Muhammad concerning Me, then answer them), I am indeed near (to them by My knowledge). I respond to the invocations of the supplicant when he calls on Me (without any mediator or intercessor). So let them obey Me and believe in Me, so that they may be led aright.)

Allah hears the Servant's Supplication

Imam Ahmad reported that Abu Musa Al-Ash`ari said, "We were in the company of Allah's Messenger during a battle. Whenever we climbed a high place, went up a hill or went down a valley, we used to say, `Allah is the Most Great,' raising our voices. The Prophet came by us and said:

«يَا أَيُّهَا النَّاسُ، ارْبَعُوا عَلى أَنْفُسِكُمْ، فَإِنَّكُمْ لَا تَدْعُونَ أَصَمَّ ولَا غَائِبًا، إنَّمَا تَدْعُونَ سَمِيعًا بَصِيرًا، إنَّ الَّذي تَدْعُونَ أَقْربُ إِلَى أَحَدِكُمْ مِنْ عُنُقِ رَاحِلَتِهِ، يا عَبْدَاللهِ بْنَ قَيْسٍ، أَلَا أُعَلِّمُكَ كَلِمَةً مِنْ كُنُوزِ الْجَنَّةِ؟ لَا حَوْلَ وَلَا قُوَّةَ إِلَّا بِالله»

(O people! Be merciful to yourselves (i.e., don't raise your voices), for you are not calling a deaf or an absent one, but One Who is All-Hearer, All-Seer. The One Whom you call is closer to one of you than the neck of his animal. O `Abdullah bin Qais (Abu Musa's name) should I teach you a statement that is a treasure of Paradise: `La hawla wa la quwwata illa billah (there is no power or strength except from Allah).')

This Hadith was also recorded in the Two Sahihs, and Abu Dawud, An-Nasa'i, At-Tirmidhi and Ibn Majah recorded similar wordings. Furthermore, Imam Ahmad recorded that Anas said that the Prophet said:

«يَقُولُ اللهُ تَعَالى أَنَا عِنْدَ ظَنِّ عَبْدِي بِي وَأَنَا مَعَهُ إِذَا دَعَانِي»

("Allah the Exalted said, `I am as My servant thinks of Me, and I am with him whenever he invokes Me.') Allah accepts the Invocation

Imam Ahmad also recorded Abu Sa`id saying that the Prophet said:

«مَا مِنْ مُسْلِمٍ يَدْعُو اللهَ عَزَّ وَجَلَّ بِدَعْوَةٍ لَيْسَ فِيها إِثْمٌ ولَا قَطِيعَةُ رَحِمٍ، إلَّا أَعْطَاهُ اللهُ بِهَا إِحْدَى ثَلَاثِ خِصَالٍ: إِمَّا أَنْ يُعَجِّل لَهُ دَعْوَتَهُ، وَإِمَّا أَنْ يَدَّخِرَهَا لَهُ فِي الأُخْرَى، وَإِمَّا أَنْ يَصْرِفَ عَنْهُ مِنَ السُّوءِ مِثْلَهَا»

قَالُوا: إذًا نُكْثِرُ؟ قَالَ:

«اللهُ أَكْثَر»

(No Muslim supplicates to Allah with a Du`a that does not involve sin or cutting the relations of the womb, but Allah will grant him one of the three things. He will either hasten the response to his supplication, save it for him until the Hereafter, or would turn an equivalent amount of evil away from him.'') They said, "What if we were to recite more (Du`a).'' He said, (There is more with Allah.)

`Abdullah the son of Imam Ahmad recorded `Ubadah bin As-Samit saying that the Prophet said:

«مَا عَلى ظَهْرِ الأَرْضِ مِنْ رَجُلٍ مُسْلِمٍ يَدْعُو اللهَ عَزَّ وَجَلَّ بَدَعْوَةٍ إِلَّا آتَاهُ اللهُ إيَّاهَا، أَوْ كَفَّ عَنْهُ مِنَ السُّوءِ مِثْلَهَا مَا لَمْ يَدْعُ بِإِثْمٍ أَوْ قَطِيعَةِ رَحِم»

(There is no Muslim man on the face of the earth who supplicates to Allah but Allah would either grant it to him, or avert a harm from him of equal proportions, as long as his supplication does not involve sin or cutting the relations of the womb.) At-Tirmidhi recorded this Hadith.

Imam Malik recorded that Abu Hurayrah narrated that Allah's Messenger said:

«يُسْتَجَابُ لأَحَدِكُمْ مَالَمْ يَعْجَلْ، يَقُولُ: دَعَوْتُ فَلَمْ يُسْتَجَبْ لِي»

(One's supplication will be accepted as long as he does become get hasty and say,

The work for the Khilafah is unaffected by the plots of America

The work for the Khilafah Rashidah penetrates the obstacles of the colonialist states and their agents, unaffected by the plots of America or her ambassador in Lebanon

It is a glad tiding given by the Messenger of Allah (saw): “…then there will be a Khilafah on the method of Prophethood” (Ahmad). That good news – the hope, amidst the dark violent winds which besiege the Muslim lands: from crushed and overwhelmed Palestine, to exhausted and bleeding Iraq, to wartorn and fragmented Sudan, and Afghanistan surrounded by invading armies, and then to Lebanon where there is division without end and without hope and where the political establishment, with its various wings, has not ceased in its move towards the unknown, riddled with threats and warnings of division, transgression, tribulations and assassinations. Amidst all this darkness, Hizb ut-Tahrir proceeds ploughing ahead toward the goal of salvation, the goal of liberation, the goal of al-Khilafah al-Rashidah, working hard, night and day, in order to return the illumination of the laws of the eminent Shari’ah to the reality of life, and to bless humanity with the justice of Islam.

With the establishment of the Khilafah drawing ever-nearer, America has rekindled and strengthened her attacks, in an attempt to stop the Ummah's extended reach toward freeing herself from America’s clutch. Thus President George Bush delivers warning upon warning about the ‘Caliphate’; the most recent one being in his address on the 28th of August in which he yet again warned of the “caliphate extending from Spain to Indonesia”. Joining him recently was the French President Nicholas Sarkozy who began his first address as president on the 27th of August mentioning the “threat of a confrontation between Islam and the West”, pointing toward the International Conference convened by Hizb ut-Tahrir in the Indonesian capital Jakarta on the topic of ‘Reviving the Islamic Khilafah’.

Since the submission of the papers for the informing of Hizb ut-Tahrir being a political party in Lebanon was forwarded to the Interior Ministry, the various power-brokers inside and outside of Lebanon opposed it openly and aggressively. The foremost of these complainants were the Americans, both from the White House itself and upon the tongue of the American Ambassador in Lebanon. Even the interim Interior Minister at the time announced that “the complaints are not only from the White House, they are also coming from the British embassy and many others.” According to this position the American Ambassador induced some of the political parties within Lebanon to work to ban the Hizb, and to revoke the submission it forwarded. Some regional regimes also contributed to this campaign, through the use of some newspapers, television channels and ‘Lebanese’ organisations, including those power-brokers inside Lebanon supported by those regimes. The most recent chapter of this campaign occurred just weeks ago. The Hizb responded to this campaign comprehensively through its leaflets, conferences and media interviews silencing most of these voices.

And now, with the shining success achieved by the conferences of Hizb ut-Tahrir which gathered tens of thousands of its members and supporters across the world, including Lebanon, the American ambassador in Lebanon has moved aggressively to recruit new political sides within Lebanon and add them to the army of agitators and partisans against Hizb ut-Tahrir and its call. At the head of these new ‘recruits’ are two groups pf people:

1. The ministers inside the government who are launching, as is their usual habit, sectarian incitements without considering the possible consequences of their moves such as increasing sectarian conflicts and their dangers.

2. The more dangerous, those people who adopt the form of a sincere advisor as government or non-government consultants, who have joined the ranks of this campaign, aggressively fighting anyone who calls for the resumption of the Islamic way of life, intently working to keep secularism established and defending it from any ideological threats. The justification used by these people for their attack on Hizb ut-Tahrir is in line with what they expressed, “The deep contradiction between the thought of Hizb ut-Tahrir and the thought of the modern nation-state, and issues of patriotism and freedoms in Lebanon and the Arab and Islamic Worlds.”

As for the ministers contributing to this campaign, we say to them:
Be warned of being dragged into this campaign led by the American Ambassador, against people who you live with in one land! This will bring about divisions and cause hatred amongst the people. Do you then think that the Americans are more trustworthy for you than the Muslims who have lived peacefully with you for centuries?!

As for those consultants who adopt the form of a sincere advisor and incite hatred in the hearts of those who trust them, we say to them:
Your plots have been exposed, and the level of your actions and words fell when you decided to push the political resolution against those who exposed you with the power of ideas through evidence and proof. If you want a real ideological confrontation, we are always ready to confront ideas with ideas and proofs with proofs, but always those weak in thought are frightened by ideological confrontations. Until you respond to this challenge – and we doubt that you will – we go on to say:

Indeed Hizb ut-Tahrir has made the resumption of the Islamic way of life its vital cause. It was established on the Islamic creed, it adheres to the Islamic Law (Shari’ah) and carries the Islamic concepts, and strives with all its ability to resume the Islamic way of life. Thus it does not speak about anything other than with regard to Islam. All its actions are verified in accordance with Islam. So whosoever knows this but still insists with fighting against its ideology, then such a person announces a fight against Islam, not against our members. And whoever opposes our call, let him call and debate with us in front of everyone at a venue of his choice, instead of plotting against us from behind the scenes.

As for our respected scholars, we say to them:
The leaders of this campaign are relying on the negative attitude of some of you toward to hizb, even if it is few, to create the false notion that the call for Khilafah, which the Prophet (saw) gave glad tidings of, is abandoned even by the scholars themselves. So if you allow them to achieve their goal, they will turn you against your brothers and will use you as a part of the war on Islam and those who work for it, a position not worthy of the honour of those with knowledge like you. Rather the believers are relying on you to be a preventative barrier in the face of the plots of these conspirators.

As for the government, we say to them:
Hizb ut-Tahrir, whose informing was approved more than a year ago was and still remains and will remain as it is. It does not change and will not change by the Will of Allah. Indeed the Hizb established its presence in Lebanon, raised its voice and its ideas became popular before the informing was accepted, in spite of the arrests, torture, and intimidation campaigns members of the hizb were exposed to. These increased them in firmness from strength to strength. Thus the repression which the hizb faced from the governmental agencies in Lebanon is a factor in the spreading of news of the hizb and the struggle of its members and their resoluteness upon the Truth, a matter which caused these agencies a permanent headache. As for the hizb, it remained, even after the informing, working on its path, without change or alteration, and without partaking in the destabilising of the security in Lebanon or sectarian conflicts, upon which the political parties of Lebanon are habituated to. The hizb will remain on its path even if it is officially recognised by the government or not, knowing full well that there is no lawful reason for its banning And whoever seeks to prevent the work for Khilafah through repression or banning or suppression of opinion, moving on the path of the governments who came before, we from our side are prepared to deal with any kind of conditions, without exception. However, remember that you are exposing yourself to the anger of Allah, and the anger of the Ummah, and you are turning against your own constitution, laws and slogans and the vision you have sloganised for Lebanon. It has become apparent to everyone that you are narrower in vision than even some of the Arab and non-Arab regimes who pretend to uphold ‘freedom of opinion’ who have not reached the level of banning Hizb ut-Tahrir.

As for the American Ambassador and his State behind him, we say to you:
That which Hizb ut-Tahrir strives toward will definitely occur, by the Will of Allah, the Exalted. Soon, for Islam there will be State in one of the Muslim lands, from where it will spread and unite the Muslim Ummah under the banner of one Khalifah. Then people like you will not be able to move around freely, commanding and prohibiting, without anyone to hold you accountable. Allah, the Exalted says:

هُوَ الَّذِي أَرْسَلَ رَسُولَهُ بِالْهُدَى وَدِينِ الْحَقِّ لِيُظْهِرَهُ عَلَى الدِّينِ كُلِّهِ وَلَوْ كَرِهَ الْمُشْرِكُونَ

“He (Allah) is the one who sent His Messenger with the guidance and the true way of life that it may become dominant over all other ways of life, even if the polytheists detest it” [al-Tauba: 33]

As for our brothers in Lebanon, we say to them:
Conspiracies have always been designed against you and your interests, whilst you have been unaware. Here today we expose one chapter from the many chapters of these conspiracies upon your deen, upon your imminent Khilafah and upon those who work for it, so show Allah from yourselves that which he, the Exalted, loves and is pleased with: a honourable, dignified, and manly stand in the face of the aggressive attack upon your deen, and the body which implements it, the Khilafah. So take a resolute stand as your Islam teaches you. Allah says,

مِنَ الْمُؤْمِنِينَ رِجَالٌ صَدَقُوا مَا عَاهَدُوا اللَّهَ عَلَيْهِ

“And from amongst the Believers are men who have been true to their covenant with Allah” [al-Ahzab: 23]

Make Ramadhan the month of victory again

O Muslims! Make Ramadhan the month of victory again by re-establishing the Khilafah

Alhamdulillah, the blessed month of Ramadhan is upon the Muslims again. Ramadhan is the month within which al-Quran al-Kareem was sent down from Lauh al-Mahfooz to Bayt ul-Izza. It is the month within which there is a night, Laylut al-Qadr, which is better than a thousand months for those who witness it in worship. And it is the month in which Allah سبحانه وتعالى commands the Muslims to fast, ties up the Shayateen, locks the gates of Hell and opens the gate of Heaven, allowing the Muslims to raise themselves in piety and draw strength from their Lord, Al-Qawwy, Al-Azeem.

Previous generations of Muslims, in the period of ruling by the Book of Allah سبحانه وتعالى, drew from the abundant blessings of Ramadhan to achieve victory over the kuffar. Under the leadership of RasulAllah صلى الله عليه وسلم the Islamic State defeated the leading tribe amongst the Arabs, the Quray’sh, at the battle of Badr. This was despite the fact that the Islamic State’s army was small in number, poorly equipped and outnumbered three-fold by a powerful and experienced adversary. Allah سبحانه وتعالى said,

وَلَقَدْ نَصَرَكُمْ اللَّهُ بِبَدْرٍ وَأَنْتُمْ أَذِلَّةٌ فَاتَّقُوا اللَّهَ لَعَلَّكُمْ تَشْكُرُونَ

“And Allah already helped you in Badr when you were a weak little force. So fear Allah and be grateful to him.” [Surah Aali-Imran 3:123]

Also, during Ramadhan, the Islamic State undertook the Opening of Makkah (Fatah Makkah) that finally brought the Qur’aysh under the Islamic authority, ending their tyranny over others and paved the way for the rapid expansion of the Islamic State throughout the lands. After the Opening of Makkah, Allah سبحانه وتعالى said,

إِذَا جَاءَ نَصْرُ اللَّهِ وَالْفَتْحُ
وَرَأَيْتَ النَّاسَ يَدْخُلُونَ فِي دِينِ اللَّهِ أَفْوَاجًا

“When the Help and Victory of Allah comes. And you see the people enter in droves into Islam.” [Surah An-Nasr 110:1-2]

And in the centuries of Islamic rule after the era of RasulAllah صلى الله عليه وسلم and the Khulafa’a Rashida رضوان الله عليهم, the Islamic Khilafah State achieved major victories during Ramadhan whilst facing formidable enemies. The Muslims succeeded in expelling the occupying Crusaders from Ash-Sham even though they had settled on some parts of it for well over a century. The Muslims prevailed over the barbaric Tartars at Ein Jaloot, even though they had reigned terrible destruction upon the Muslims before.

So, whilst the Muslims ruled by Islam, with their affairs governed by all that Allah سبحانه وتعالى has revealed, Ramadhan was the month of victory over the enemies of Islam and Muslims. However, this Ramadhan, without the Islamic Khilafah State, the Ummah faces subjugation by the kuffar in almost every sphere of life.

This Ramadhan the Muslims count their dead as the kuffar nations enforce their occupation of Muslims Lands in Afghanistan, Iraq, Palestine and Kashmir. This Ramadhan, the armies of the Muslims are withheld from helping the Muslims but are sent without hesitation to protect the kuffar from the Muslims. This Ramadhan, the Muslims face an onslaught against their most precious possession, their deen, as the Western colonialists spread corrupt Western culture through reforming the education syllabuses as well as through the media and advertising. And this Ramadhan, Muslims face mounting hardships as the Western colonialists exploit the immense resources of the Ummah.

So, despite the fact that the Ummah is a giant in terms of its lands, material resources, population and armies and its greatest asset, the one true deen, Islam, it lies in humiliation before the kuffar. This matter was inevitable because without the Islamic Khilafah State, politics and ruling are no longer about ordering the Ma’roof (Good) and forbidding the Munkar (Evil). Instead politics and ruling have been reduced to ordering what the colonialists desire and forbidding what the colonialists detest. Politics is no longer about looking after the affairs of the Muslims by seeking the good pleasure of Allah سبحانه وتعالى. Instead politics has been sullied into to a cheap competition to please the colonialists, between the current rulers and those who seek to succeed them in ruling.

O Muslims of Pakistan!
This Ramadhan, with the Ummah suffering immensely due to the mischief of the kuffar, you must not be satisfied by turning to Allah سبحانه وتعالى through prayer and fasting alone. Rather you must also work to implement the deen of Allah سبحانه وتعالى on the earth and ensure its dominance over all other ways of life by re-establishing the Islamic Khilafah State, so that Ramadhan witnesses victory after victory again. The work to change the current corrupt rulers and re-establish the Khilafah in their place is not just a matter of life and death, it is an obligation from Allah سبحانه وتعالى. If the Muslims did not perform this duty, it would be an acceptance of the many sins of the rulers. The situation of the Muslims will become worse in the Dunya and they will deserve the punishment in the Aakhira. RasulAllah صلى الله عليه وسلم said,

إِنَّ اللَّهَ عَزَّ وَجَلَّ لَا يُعَذِّبُ الْعَامَّةَ بِعَمَلِ الْخَاصَّةِ حَتَّى يَرَوْا الْمُنْكَرَ بَيْنَ ظَهْرَانَيْهِمْ وَهُمْ قَادِرُونَ عَلَى أَنْ يُنْكِرُوهُ فَلَا يُنْكِرُوهُ فَإِذَا فَعَلُوا ذَلِكَ عَذَّبَ اللَّهُ الْخَاصَّةَ وَالْعَامَّةَ

“Allah will not punish the common people due to the work of specific people, until they see the munkar amongst themselves and they were able to forbid it but they did not do that. If they did that Allah will punish the specific people and the common people.” (Ahmad)
So, benefit fully from the blessings of Ramadhan. Turn to Allah سبحانه وتعالى by intensifying your struggle against the corrupt rulers and re-establish the Khilafah in their place. Only the Khilafah will re-establish Islam as an authority that would protect the Muslims and their deen and strike fear into the hearts of the enemies. And know that Allah سبحانه وتعالى has promised you victory if you are true to Him alone. Allah سبحانه وتعالى says,

وَلاَ تَهِنُوا وَلاَ تَحْزَنُوا وَأَنْتُمْ الأَعْلَوْنَ إِنْ كُنْتُمْ مُؤْمِنِينَ

“So do not become weak, nor be sad, and you will be superior (in victory) if you are indeed (true) believers.” [Surah Aali-Imran 3:139]

An-Nahda Institute - courses & online presentations

An-Nahdah Institute has been established due to the shortage in academic Islamic institutions presenting Islamic studies in a relevant fashion. While there are several establishments that offer Islamic studies, they are either inaccessible, unaffordable, or present Islamic education as a classical literature without relating it to the current time and situation that Muslims are experiencing.

Al-Yaasiq of today - the law applied in the Muslim world

When the Tatars took over Iraq, the centre of the Abbasid Khilafah instead of displacing all of Islam, they kept some aspects just as the rulers do today in the Muslim world. The adhaan could still be heard coming from the masajid and some of the laws of Islam were held in place. The Tatars, in addition to borrowing the Islamic laws, also borrowed laws from Judaism, Christianity, and even had laws invented by their king, Genghis Khan, the leader of the conquering army against Baghdad. All of these laws were then made into one codified law, in a book entitled, al-Yaasiq and sometimes-pronounced al-Yasaa.

The great scholar Ibn Kathir رحمه الله articulates the history surrounding this law that the Tatars made for themselves:

“His book, which is alYasaa, most of it differs from the Shari`a of Allah and His Books. When he (Genghis Khan) died in the year 624 AH (1227 AD), they put him in an iron tabuk (enclosed container), they chained him in between two mountains and left him there. His book alYasaa has two volumes, large in size and to be carried on a camel. In his books, there are such extracts as, ‘Whoever commits fornication, he should be killed, married or not. Whoever does a homosexual act should be killed. Whoever deliberately lied, he should be killed. The one who does magic should be killed. Whoever spies should be killed. Anyone trying to intervene between two opponents, helping one against the other, he should be killed. The one who urinates or dives into stagnant water should be killed.

‘Anyone who feeds a captive or gives him clothing, drink or food without family permission should be killed. Anyone who threw any food to anyone should be killed. He should give it by hand. Anyone who wants to give sadaqa (voluntary charity) from food should eat it first, even if he wants to give it to someone high in the society. Whoever eats and does not feed his guests or household should be killed. Whoever slaughters an animal should be killed. He should cut it in half and take the heart out first.’

He also explained: “This all differs with the Shari`a which Allah revealed to his Messengers. Whoever leaves the decisive Shari`a which has been revealed to Muhammad ibn `Abdullah, the Seal of the Prophets, and he goes for judgment to other than his (Muhammad’s) Shari`a which has been abrogated by his (Muhammad’s) Shari`a, he becomes a kaafir. What about those who are not ruled by an abrogated Shari`a, but alYaasa, and he puts it before the Shari`a of Muhammad? Certainly, whoever does that, he becomes a kaafir unanimously, by the consensus of the Muslims. Allah says,

أفحكم الجاهلية يبغون و من أحسن الله حكماً لقوم يوقنون

‘Is it the legislation/rule of the Days Jaahiliyyah (Days of Ignorance) that they seek? And who is better in judgment than Allah for a people who are certain?!’

فلا و ربك لا يؤمنون حتى يحكموك فيما شجر بينهم ثم لا يجدوا في أنفسهم حرجاً مما قضيت و يسلموا تسليماً

‘No, by your Lord [O Muhammad r], they will not believe until they make you the judge in what they differed in, then they do not find in themselves any dispute from what you judged and they submit completely.’

Allah has spoken the truth in this matter.”

Sheikh Ahmad Muhammad Shaakir (1892-1958), the renowned Qadi of Egypt said relating to this topic:

“Is it then lawful with this in the Shari`a of Allah that he judge the Muslims in their lands by the legislation of pagan, atheistic Europe? On the contrary, the legislation comes from false and fabricated opinions. They change it and replace it according to their whims.
No, its inventor is unconcerned or remote from the Shari`a or its violation. The Muslims have not been tested by this, as far as we know of in their time, except in that time, the time of the Tartars. And it was a wicked time, a period of great oppression and darkness.
Thus in these clearly invented laws, as clear as the sun, it is clear kufr, no doubt about it. There is no persuasion and there is no excuse for any one who is affiliated to Islam, being whoever it may, in acting on it, submission to it or establishing it.”

Sheikh Muhammad ibn Ibrahim, a previous Mufti of the Arabian Peninsula said:

“As far as the saying, kufr duna kufr, it is when the judge makes judgement to other than Allah with firm conviction that it is disobedience. He believes that the judgement of Allah is the truth, but he left from it in one matter. As far as whoever made laws in succession and makes others submit to it, then it is kufr, even if they said, ‘We sinned and the judgement of the Revealed Law is more just.’ This is still kufr that removes from the religion.” [Fatawa of Muhammad ibn Ibrahim Aal ash-Sheikh, V. 12, pg. 280]

He said in a famous speech in 1960:

"And it (the major kufr of replacing the Shari`a) is more enormous, more universal, more distinct and more clear in its stubborn opposition to the Shari`a. And stubbornness and arrogance to his judgements, being lax to Allah and His Messenger, making resemblance to the Shari`a courts, arranging, setting up, preparing, establishing a foundation, making applications and usage, shaping, forming and organising, of a mixture of various things and themes in the process of modification (of the Shari`a), making judgement, making it compulsory, and making judgements by turning to authorities.

Then just as the Shari`a courts turn to authorities, all of them (the authorities) returning to the Book of Allah and the Sunna of His Messenger (SAW), then what the authorities turn to of it (the false Shari`a) are concocted and trumped up laws from various Shari`as, several different law systems, such as French law, American law, British law and other laws and from different schools of thought, some attributing bid`a and other things to the Shari`a.

Then these courts are now in most of the urban centres of Islam, prepared, perfect and complete, the doors have been opened and people are swarming to them one after another, their rulers judging between them by what is in direct opposition and contradiction to the judgement of the Sunna and the Book, from the judgements of that law (the false Shari`a) and coercing them to it and establishing it over the Shari`a (the true Shari`a of Allah) and imposing and making it incumbent on them. Then which kufr is over and above (more amplified and clearer) this kufr? And which opposition to the Shahada that Muhammad is the Messenger of Allah is after this opposition and violation.” [Tahkim alQawanin, pg. 7]

There is legitimate difference of opinion on whether the ruler becomes Kafir by ruling by other than what Allah (swt) has revealed or whether it is kufr asghar (minor kufr) by which the ruler becomes a sinner (fasiq) and not a disbeliever. However the scholars unanimously agree that ruling by other than what Allah (swt) revealed is a Qat'i prohibition.

Ibn Abeel-'Izz Al-Hanafee said: "Judging by other than what Allah has revealed could be kufr that expels one from the religion and could be a sin either a major sin or a minor one and it could be a symbolic kufr or minor kufr based on the two sayings and this all depends on the situation of the judge: So if he believes that judging by what allah has revealed is not obligatory or that he has the option in this or if he dishonours it(The judgement of Allah) while being certain that it is the judgement of Allah then this is major kufr and if he believes in the obligation of judging by what allah has revealed in this instance but turnsaway from it while recognizing that he deserves to be punished then he is a sinner and is to be referred to as a disbeliver symbolically or upon minor disbelief". Tafsir of verses on Ramadhan & Fasting - Part 1

The following is from the english translation of the Tafsir of Ibn Kathir:

The Order to Fast

In an address to the believers of this Ummah, Allah ordered them to fast, that is, to abstain from food, drink and sexual activity with the intention of doing so sincerely for Allah the Exalted alone. This is because fasting purifies the souls and cleanses them from the evil that might mix with them and their ill behavior. Allah mentioned that He has ordained fasting for Muslims just as He ordained it for those before them, they being an example for them in that, so they should vigorously perform this obligation more obediently than the previous nations. Similarly, Allah said:

[لِكُلٍّ جَعَلْنَا مِنكُمْ شِرْعَةً وَمِنْهَـجاً وَلَوْ شَآءَ اللَّهُ لَجَعَلَكُمْ أُمَّةً وَحِدَةً وَلَـكِن لِّيَبْلُوَكُمْ فِى مَآ ءَاتَـكُم فَاسْتَبِقُوا الخَيْرَاتِ]

(To each among you, We have prescribed a law and a clear way. If Allah had willed, He would have made you one nation, but that (He) may test you in what He has given you; so compete in good deeds.) (5:48)

Allah said in this Ayah:

[يأَيُّهَا الَّذِينَ ءَامَنُواْ كُتِبَ عَلَيْكُمُ الصِّيَامُ كَمَا كُتِبَ عَلَى الَّذِينَ مِن قَبْلِكُمْ لَعَلَّكُمْ تَتَّقُونَ ]

(O you who believe! Fasting is prescribed for you as it was prescribed for those before you, that you may have Taqwa).) since the fast cleanses the body and narrows the paths of Shaytan. In the Sahihayn the following Hadith was recorded:

«يَا مَعْشَرَ الشَّبَابِ مَنِ اسْتَطَاعَ مِنْكُمُ الْبَاءَةَ فَلْيتَـزَوَّجْ وَمَنْ لَمْ يَسْتَطِع فَعَلَيْهِ بِالصَّوْمِ فَإِنَّهُ لَهُ وِجَاء»

.(O young people! Whoever amongst you can afford marriage, let him marry. Whoever cannot afford it, let him fast, for it will be a shield for him.)

Allah then states that the fast occurs during a fixed number of days, so that it does not become hard on the hearts, thereby weakening their resolve and endurance.)

The various Stages of Fasting

Al-Bukhari and Muslim recorded that `A'ishah said, "(The day of) `Ashura' was a day of fasting. When the obligation to fast Ramadan was revealed, those who wished fasted, and those who wished did not.'' Al-Bukhari recorded the same from Ibn `Umar and Ibn Mas`ud.

Allah said:

[وَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ]

(...those who can fast with difficulty, (e.g., an old man), they have (a choice either to fast or) to feed a Miskin (poor person) (for every day).)

Mu`adh commented, "In the beginning, those who wished, fasted and those who wished, did not fast and fed a poor person for each day.'' Al- Bukhari recorded Salamah bin Al-Akwa` saying that when the Ayah:

[وَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ]

(...those who can fast with difficulty, (e.g., an old man), they have (a choice either to fast or) to feed a Miskin (poor person) (for every day).) was revealed, those who did not wish to fast, used to pay the Fidyah (feeding a poor person for each day they did not fast) until the following Ayah (2:185) was revealed abrogating the previous Ayah. It was also reported from `Ubaydullah from Nafi` that Ibn `Umar said; "It was abrogated.'' As-Suddi reported that Murrah narrated that `Abdullah said about this Ayah:

[وَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ]

(those who can fast with difficulty, (e.g., an old man), they have (a choice either to fast or) to feed a Miskin (poor person) (for every day).) "It means `those who find it difficult (to fast).' Formerly, those who wished, fasted and those who wished, did not but fed a poor person instead.'' Allah then said:

[فَمَن تَطَوَّعَ خَيْرًا]

(But whoever does good of his own accord) meaning whoever fed an extra poor person,

[فَهُوَ خَيْرٌ لَّهُ وَأَن تَصُومُواْ خَيْرٌ لَّكُمْ]

(it is better for him. And that you fast is better for you) Later the Ayah:

[فَمَن شَهِدَ مِنكُمُ الشَّهْرَ فَلْيَصُمْهُ]

(So whoever of you sights (the crescent on the first night of) the month (of Ramadan, i.e., is present at his home), he must observe Sawm (fasting) that month) (2:185) was revealed and this abrogated the previous Ayah (2:184).

The Fidyah (Expiation) for breaking the Fast is for the Old and the Ailing

Al-Bukhari reported that `Ata heard Ibn `Abbas recite:

[وَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ]

(And as for those who can fast with difficulty, (e.g., an old man), they have (a choice either to fast or) to feed a Miskin (poor person) (for every day).)

Ibn `Abbas then commented, "(This Ayah) was not abrogated, it is for the old man and the old woman who are able to fast with difficulty, but choose instead to feed a poor person for every day (they do not fast).'' Others reported that Sa`id bin Jubayr mentioned this from Ibn `Abbas. So the abrogation here applies to the healthy person, who is not traveling and who has to fast, as Allah said:

[فَمَن شَهِدَ مِنكُمُ الشَّهْرَ فَلْيَصُمْهُ]

(So whoever of you sights (the crescent on the first night of) the month (of Ramadan, i.e., is present at his home), he must observe Sawm (fasting) that month.) (2:185)

As for the old man (and woman) who cannot fast, he is allowed to abstain from fasting and does not have to fast another day instead, because he is not likely to improve and be able to fast other days. So he is required to pay a Fidyah for every day missed. This is the opinion of Ibn `Abbas and several others among the Salaf who read the Ayah:

[وَعَلَى الَّذِينَ يُطِيقُونَهُ]

(And as for those who can fast with difficulty, (e.g., an old man)) to mean those who find it difficult to fast as Ibn Mas`ud stated. This is also the opinion of Al-Bukhari who said, "As for the old man (person) who cannot fast, (he should do like) Anas who, for one or two years after he became old fed some bread and meat to a poor person for each day he did not fast.''

This point, which Al-Bukhari attributed to Anas without a chain of narrators, was collected with a continuous chain of narrators by Abu Ya`la Mawsuli in his Musnad, that Ayyub bin Abu Tamimah said; "Anas could no longer fast. So he made a plate of Tharid (broth, bread and meat) and invited thirty poor persons and fed them.'' The same ruling applies for the pregnant and breast-feeding women if they fear for themselves or their children or fetuses. In this case, they pay the Fidyah and do not have to fast other days in place of the days that they missed.

[شَهْرُ رَمَضَانَ الَّذِى أُنزِلَ فِيهِ الْقُرْآنُ هُدًى لِّلنَّاسِ وَبَيِّنَـتٍ مِّنَ الْهُدَى وَالْفُرْقَانِ فَمَن شَهِدَ مِنكُمُ الشَّهْرَ فَلْيَصُمْهُ وَمَن كَانَ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِّنْ أَيَّامٍ أُخَرَ يُرِيدُ اللَّهُ بِكُمُ الْيُسْرَ وَلاَ يُرِيدُ بِكُمُ الْعُسْرَ وَلِتُكْمِلُواْ الْعِدَّةَ وَلِتُكَبِّرُواْ اللَّهَ عَلَى مَا هَدَاكُمْ وَلَعَلَّكُمْ تَشْكُرُونَ ]

(185. The month of Ramadan in which was revealed the Qur'an, a guidance for mankind and clear proofs for the guidance and the criterion (between right and wrong). So whoever of you sights (the crescent on the first night of) the month (of Ramadan, i.e., is present at his home), he must observe Sawm (fasting) that month, and whoever is ill or on a journey, the same number [of days which one did not observe Sawm (fasting) must be made up] from other days. Allah intends for you ease, and He does not want to make things difficult for you. (He wants that you) must complete the same number (of days), and that you must magnify Allah [i.e., to say Takbir (Allahu Akbar: Allah is the Most Great)] for having guided you so that you may be grateful to Him.)
