Q&A- The Nisaab for Zakah

These are two important questions related to zakah and they have been translated from the book "Selected Fiqh Issues" , It is authored by the Mujtahid Sheikh Abu Iyas Mahmoud Abdul Latif al-Uweida (May Allah protect him).

The book contains 321 issues in the form of questions and answers related to Salah (prayer), fasting, Zakah, Hajj, Umrah, economics, ruling, social relations and Jihad. The Sheikh has selected from the questions which he responded to between 1993 and 2007. The Sheikh has also given express permission to all those wishing to print, publish and distribute the book.

الجواب :- من ملك نقودا ورقية فان كانت نائبة عن الذهب قومها بنصاب الذهب وان كانت نائبة عن الفضة قومها بنصاب الفضة وكذلك الاوراق النقدية الوثيقة .

اما الاوراق الالزامية التي ليست نائبة ولا وثيقة فانها تقدر باقل النصابين ذهبا كان او فضة لان الاوراق مادامت ليست نائبة ولا وثيقة فاذا بلغت قيمة اقل النصابين يعتبر ان صاحبها قد ملك نصابا لذلك تقوم باقل النصابين قيمة .

In today’s system fiat system The Measurement of the Nisab for zakah,is done by Gold or by Silver.? As we from ahadith that the Nisab for gold is 7.5 Tola and 52 tola if Silver. What do we take as the Basis for nisab , silver or gold?

Whoever holds paper money which is backed by gold then he goes ahead with his nisaab in gold as for the one who has paper money which is backed by silver, in this case he calculates his nisab based on the nisab of silver i.e 52 tola.
As for that currency which is not back by gold or by silver then it is calculated by the smaller of the nisabs from gold or silver since the paper currency backed by an asset, so the nisab would be calculated on the lesser of the two in value.

تأخير الزكاة بحجة عدم وجود نقود مع التاجر

- ان عدم وجود نقود مع الشخص لا يبيح له تأخير الزكاة فهو قادر ان يبيع العروض وان يدفع ثمنها حتى لو اشتراها الشخص ثم اعطى ثمنها الذي دفعه زكاة جاز ذلك لان اختلاف العقد ينفي موضوع الحيلة .


Is it allowed to delay the zakah due to absence of hard cash in possession of a trader?

Answer:- the absence of currency/ cash with a man does not permit him to delay the zakah because he is capable of selling his goods even if his good is bought by a person whom he then gives his zakah to.

Wall Street’s daylight robbery

Roughly a year after accepting unprecedented financial aid to shore up its operations, Wall Street firm Goldman Sachs Group Inc. posted yet another impressive quarter that further distances itself from rivals, many of which are still struggling to overcome the credit crisis. The strong results -- a profit of $3.19 billion, or $5.25 a share, for the three months ended Sept. 25, up from $845 million, or $1.81 a share, a year earlier -- were greeted with a barrage of questions about Goldman's decision to set aside compensation at a breathtaking pace; its 31,700 employees are on track to earn an average of about $700,000 apiece in 2009, a record for the 140-year-old firm. Goldman is not alone in this daylight robbery of US tax payers’ money. Morgan Stanley, Wells Fargo and other US banks have also posted huge profits.

The profits are a result of Obama’s administration handing over US tax payer’s money disguised as bail out packages to the banks. The banks have then taken advantage of record low interest rates to lend out money at higher rates thereby using the difference to generate huge profits. The resulting inequality between bankers pay and poverty stricken citizens is being touted as way of creating prosperity for all. The vice-chairman of Goldman Sachs said,”We have to accept that inequality is a way of achieving greater opportunity and prosperity for all”

UK Government blackmailing Muslims into spying

A multi-million pound government scheme designed to prevent the radicalization of young British Muslims is being used to gather intelligence about innocent people not suspected of terrorism involvement. The “Preventing Violent Extremism”, also known as Prevent, was launched three years ago as part of the Government's four "Ps" anti-terror agenda - Prevent, Pursue, Protect and Prepare. But reports have suggested the programme was instead being used to gather intelligence about innocent people who are not suspected of involvement in terrorism. The Institute of Race Relations said the Prevent scheme had been used "to establish one of the most elaborate systems of surveillance ever seen in Britain ". Some involved in the programme told the Guardian of their fears that they are being co-opted into spying. Several sources involved in the programme reportedly said it gathered intelligence about the thoughts and beliefs of Muslims who were not involved in criminal activity. Among the topics asked included gathering information about the sexual, religious and political views of innocent people as well as information about their mental health.

Resetting US Iranian relations: Tehran mulls uranium export plan

This week the BBC reported that Iran and three world powers have been handed a draft agreement aimed at reducing international concerns over Tehran 's nuclear programme. Details are yet to be confirmed, but the plan is believed to involve Iran exporting uranium to be enriched in France and Russia . Iran 's chief negotiator has not commented on the uranium export plan. The negotiations have involved the UN, Iran , France , Russia and the US . IAEA director Mohamed ElBaradei told reporters in Vienna that he was feeling "optimistic" after the talks, which he said had been "very constructive". "Everybody at the meeting was trying to help, trying to look to the future and not to the past, trying to heal the wounds that existed for many years," he said. "I have circulated a draft agreement that in my judgment reflects a balanced approach to how to move forward."

US Secretary of State Hillary Clinton urged Iran to act quickly, and said her country would continue "to discuss the full range of issues that have divided Iran and the United States for too long". She added: "The door is open to a better future for Iran , but the process of engagement cannot be open-ended. We are not prepared to talk just for the sake of talking." France said the plan was acceptable and would benefit Paris and its partners.

America aims to fix the results of the Afghan election

The United States would be receptive to a power-sharing arrangement between Afghan President Hamid Karzai and his election challenger if they agreed to it, Obama administration officials said Wednesday. Karzai and former Foreign Minister Abdullah Abdullah have settled on a Nov. 7 runoff following weeks of US pressure on Karzai. Now both Karzai and Abdullah are considering a coalition government that could either replace the runoff or follow it. A State Department official said the U.S. would not be opposed to a power-sharing deal, depending on its legitimacy and how it was implemented. The Obama administration is stressing that any such agreement is up to the Afghan government and the U.S. is not involved in any effort to forge or encourage it.
The U.S. wants a government that is legitimate in the eyes of Afghans and the international community, officials say, and at present that legitimacy appears clearest through the Afghan Constitution's requirement for a run-off vote. Sen. John Kerry, D-Mass., met repeatedly with Karzai leading up to Tuesday's announcement that a runoff would be held. Kerry gave Obama his accounting at the White House on Wednesday, and afterward told reporters that in Afghanistan he "did not discuss nor did I even attempt to put on the table the concept of a coalition." But despite his public denial Kerry acknowledged the issue was being discussed in Kabul , and said there may have been talks between the Karzai and Abdullah camps on it "even today."

Pakistani parliament formally legitimizes American tyranny over Pakistan

The federal cabinet formally accepted on Wednesday the Kerry-Lugar Bill (Enhanced Partnership Act with Pakistan Bill of 2009). Briefing the media after a cabinet meeting, Information Minister Qamaruz Zaman Kaira said there were no differences of opinions about accepting the assistance under a law which applied to the American executive. However, no sooner had Pakistan formally approved the Kerry-Lugar Bill the US Congress was looking at further ways to undermine Pakistan’s eroded sovereignty by setting out fresh conditions for military aid to Pakistan. The new limits include efforts to track where US military hardware sent to Pakistan ends up, as well as a warning that US aid to Pakistan must not upset “the balance of power in the region” — a reference to tensions with India . The limits are in a $680 billion US Defense Department spending measure for 2010 that the Senate will take up after the bill cleared the House of Representatives in a 281-146 vote on October 8.


Al-Quds cannot be liberated by resorting to protests and sit-ins…

بسم الله الرحمن الرحيم

{هَذَا بَلَاغٌ لِلنَّاسِ وَلِيُنْذَرُوا بِهِ}

Al-Quds cannot be liberated by resorting to protests and sit-ins… it can only be restored by mobilizing armed forces to eliminate the Jewish entity!

The Jews have been provoking Muslims over the al-Aqsa mosque issue day and night, sometimes by digging beneath al-Aqsa or by storming over it; sometimes they harass the worshippers, sometimes allowing them and at other times preventing them from entering the mosque, all at their own will and whim. Sometimes they send in their men for their rituals, and if the Muslims protest at this, they are confronted either with gunfire thereby killing the Muslims or with detention. And whilst this is the norm, the rulers in the Muslim lands simply count the death toll and compile a list of the injured and arrested persons. Or they merely sympathize with people, allowing them to protest and shout against the Jews and their allies without the threat of arrest or prosecution!
Of course, the Jews are not in the least bothered about these protests, much less withdraw even a step back. The Jews have a prior deal with these rulers about the Prophet Ibrahim’s sanctuary in Hebron which they have unjustly cornered for themselves and their friends: the occupying enemy coolly wanders day and night, while the people of Hebron are let in or barred from entering it- all at the will of the occupying enemy!

O Muslims! Whilst it is a great effort for the record books to sit-in and protest under the occupation and call for help to liberate the al-Aqsa mosque, it is not worth a mention in the white records that matter, it is fir for black, obscure books, that Muslims outside the occupied territories are content with protests, sit-ins, marches and virile and fiery sermons and so on!
Palestine has been occupied even earlier by the kuffar Crusaders, who spewed corruption in the precincts of al-Aqsa and spilled the blood of the martyred Muslims, which reached the knees of the soldiers on horseback! The Crusaders destroyed the minbar of al-Aqsa and converted the mosque into a stable for their horses … but the Muslims did not engage themselves in vain protests and sit-ins in order to liberate it, nor did they engage themselves in building a new pulpit under the occupation. Rather the Muslims were focused on re-organising troops under the command of Salahuddin, the Wali of Egypt and ash-Sham, under the Khilafah which ruled with Allah (swt) has revealed and which fights in His path.
The “sit-ins” of the Muslims in those times were intruding the fortresses of the crusader armies and their “protests” were shocking strikes in the faces of the aggressors, whilst the fiery sermons in those days were the cries of Allahu Akbar on the battle fields. They installed a new pulpit in the al-Aqsa mosque after liberating it and not whilst it was under occupation. They helped Allah (swt) and He provided His help, Indeed He is All Powerful.
{إِنَّ اللَّهَ لَقَوِيٌّ عَزِيزٌ}.
“Verily, Allâh is All-Powerful, All-Mighty. [TMQ: 058:021]
Such were the Muslims, strongly bonded with their deen and Allah, focused and engaged in preparing armies to liberate al-Aqsa and purify it of the Crusaders’ evil, enlightening it with cries of the Muslim soldiers who hailed the clear victory. That same path is valid now as well. Indeed the way to liberate the al-Aqsa mosque is not vague but is clear as the sun.

That way is to mobilize the Muslim armies and bring together all able bodied Muslims to eliminate the Jewish entity from its roots and only then will the al-Aqsa be liberated and cleared of the scum and evil of the Jews and their offspring…
This way is to regard the entire Palestine as one- right from the banks of the river in the east to the sea in the west, without differentiating the lands occupied in 1948 or in 1967. Whoever relinquishes even one part of the land, actually facilitates surrender of part after part, whoever displays weakness, humiliation is his destiny…
The way to restore and liberate Palestine is to trample upon all negotiations proposals, right from the so-called Road-Map to the concept of two-nations and erase every word of these and those who advocate such negotiations. Palestine can not accept being divided, it is the holy land, purely Islamic, every inch of its soil is strewn with the blood of martyrs and dust of the Mujahedeen’s horses.

The way to liberate Palestine is for the Ummah to confront its rulers in their faces and force them to mobilise the armies to fight and if they do not heed, then they should be sternly dealt with. They should be replaced by a true, sincere believer, the rightly-guided Khaleefah behind whom is fought and protection is sought, a ruler who strives to attain the pleasure of Allah (swt). No soldier should laze around in his camp or deputed for protocols as mere toothless embellishment. Their sole aim must be one of the two noble targets: either achieve victory in liberating the first Qiblah, or martyrdom.

O Muslims! The enemy has succeeded in dividing Palestine at the very basic and ground level. He has succeeded in transforming this purely Islamic issue to simply an Arab issue and then further rendered it meaningless as a mere Palestinian ”national” issue; and finally divided it into two parts: Gaza and the West Bank! It was then regarded as merely an issue of the “settlements” which was further weakened by such meaningless and semantic argument over whether all or some of the “settlements” should be stopped, frozen, controlled or monitored. The Jewish entity is not tired by these, rather under the guise of all such meaningless arguments, continues to raise pillars or walls or roofs of more “settlements” and decorates them with marble tiles!
Thus the enemies of Islam and their agents succeeded in lowering the issue from its higher platform; to these rulers it is simply a Palestinian issue at best! The rulers are far removed from it, either they remain neutral or even closer to the enemy, may Allah fight them, how do they perceive. But the most painful matter is the fact that some of the Palestinians themselves have assumed positions of honour by sinful means. They cry and tell the rulers: we do not want to mobilise the armies, we are for it! Any sane person can easily understand that liberation of Palestine and elimination of the Jewish entity can only be achieved through a State that mobilises its armed forces to defeat the Jewish entity. This is the only way and Palestine can not be restored and liberated without this. Every Muslim, inside or outside Palestine, either an individual or a group who appeals to the rulers not to mobilise the armies to save Palestine, and allow the Palestinians to languish and suffer under the cruel occupation, indeed commits treason against Allah (saw), His Prophet (saw) and all the Muslims because he accepts the continued occupation of Palestine…

O Muslims! The fathers and brothers of the Muslim soldiers…O Muslim soldiers:
Al-Aqsa is crying and Palestine is seeking your help, the Muslims are urging you. Will you respond positively and seek one of the two noble targets, i.e. victory or martyrdom, in fact they both come together and blot the faces of the Jews with scum, such Muslims will again enter the mosque like the victors had entered when they had achieved victory. The Jews in and around al-Aqsa will again be humiliated. So will you not respond?

Do you see the badly damaged and disfigured al-Aqsa and yet remain faithful to the treacherous and tyrant rulers? Are you not afraid of Allah’s wrath that befell those who disobeyed Allah and obeyed their leaders, who mislead them. They were all confined to hell-fire:

{يَوْمَ تُقَلَّبُ وُجُوهُهُمْ فِي النَّارِ يَقُولُونَ يَا لَيْتَنَا أَطَعْنَا اللَّهَ وَأَطَعْنَا الرَّسُولَا * وَقَالُوا رَبَّنَا إِنَّا أَطَعْنَا سَادَتَنَا وَكُبَرَاءَنَا فَأَضَلُّونَا السَّبِيلَا}
“On the Day when their faces will be turned over in the Fire, they will say: “Oh, would that we had obeyed Allâh and obeyed the Messenger (Muhammad saw)” [TMQ: 033:066]
Are you not the people of strength and force who can demolish the tyrants’ fortresses if they prevent you from fighting your enemy? Are you not reminded of Allah words?

{ إِلَّا تَنْفِرُوا يُعَذِّبْكُمْ عَذَابًا أَلِيمًا }؟
“If you march not forth, He will punish you with a painful torment” [TMQ: 09:039]

O Muslims! The fathers and brothers of the Muslim soldiers…O Muslim soldiers loitering in your barracks:

Is there not among you a right-thinking person who will revenge for al-Aqsa, the first Qiblah? Is there not a right thinking person among you who will revenge for the elderly Muslims and the orphans?
              Is there not among you a right thinking person who will confront the tyrant rulers who are the stooges and are preventing you from seeking either of the two noble targets and from liberating the first Qiblah? Is there not among you a right thinking person who can eliminate these despotic rulers and lead the armies to fight in the path of Allah and rule by what Allah has revealed? Such a fortunate person will find himself being mentioned by Allah Himself and such a person will be envied by the best people of the earth and the angels in the skies!

Is there not among you a right thinking person who understands what Allah has said about these Jews:

{لَنْ يَضُرُّوكُمْ إِلَّا أَذًى وَإِنْ يُقَاتِلُوكُمْ يُوَلُّوكُمُ الْأَدْبَارَ ثُمَّ لَا يُنْصَرُونَ}
“They will do you no harm, barring a trifling annoyance; and if they fight against you, they will show you their backs, and they will not be helped.” [TMQ: 03:111]

Is there not among you a right thinking person who understands what Allah’s Prophet (saw) has said about these Jews:
« لَتُقَاتِلُنَّ الْيَهُودَ فَلَتَقْتُلُنَّهُمْ حَتَّى يَقُولَ الْحَجَرُ يَا مُسْلِمُ هَذَا يَهُودِيٌّ فَتَعَالَ فَاقْتُلْهُ»
“You will fight the Jews and kill them until the stone utters:” O Muslim, here is a Jew, come and kill him.”

Is there not among you a right thinking person who loves to be honoured by Allah, the All Powerful by leading the armies in order to eliminate the Jewish state and liberate al-Aqsa from where the Prophet (saw) embarked for the Me’ raj to the high skies?

Where are the soldiers of Egypt, the land of the Canaan? Where are the soldiers of ash-Sham, the abode of the Khilafah? Where are the soldiers of Iraq, the land of the two rivers? Where are the missiles of Iran, Turkey and Pakistan?
Is it not a farce to be entangled by the Jews like the wrist is surrounded by a bracelet and yet you do not attack this entity once and for all in order to restore the entire Palestine to the fold of Islam and then raise the Adhaan from the pulpit of al-Aqsa which will be free and liberated call free from the clutches and impurity of the Jews and you will rightfully share the honour in this world and the hereafter:

{ قَاتِلُوهُمْ يُعَذِّبْهُمُ اللَّهُ بِأَيْدِيكُمْ وَيُخْزِهِمْ وَيَنْصُرْكُمْ عَلَيْهِمْ وَيَشْفِ صُدُورَ قَوْمٍ مُؤْمِنِينَ}
“Fight against them so that Allâh will punish them by your hands and disgrace them and give you victory over them and heal the breasts of a believing people,” [TMQ: 009:014]

O Muslims! The leader does not betray his people, Hizb ut Tahrir has truthfully explained to you and sincerely advised you and urges you.
He who loves Palestine, al-Quds and al-Aqsa, and he who adores the holy land of Me’raj; indeed he who loves these is one who is shaken by the events, the one whose blood curdles in his body at the sight of the Jews committing atrocities on those in seclusion inside the mosque and he sincerely strives to help, the one who works seriously with those who are working to mobilise the armies to fight and if the rulers refuse then he works to replace them with a Mujahid ruler, the Khalifah behind whom one fights and is protected. There is only one option and that is to mobilise the armies and gather all able-bodied Muslims in that army. This is the only way to eliminate the Jewish entity, save al-Quds and restore the whole of Palestine to the fold of Islam.

{هَذَا بَلَاغٌ لِلنَّاسِ وَلِيُنْذَرُوا بِهِ وَلِيَعْلَمُوا أَنَّمَا هُوَ إِلَهٌ وَاحِدٌ وَلِيَذَّكَّرَ أُولُو الْأَلْبَابِ} .
“This is a Message for mankind (and a clear proof against them), in order that they may be warned thereby, and that they may know that He is the only One Ilâh (God - Allâh) - (none has the right to be worshipped but Allâh) - and that men of understanding may take heed.” [TMQ: 014:052]

Zardari prepares to sacrifice more Muslim soldiers for the sake of America's Raj

بسم الله الرحمن الرحيم

In the early days of October 2009, the Zardari regime began to repeatedly announce the need for launching of military operations in Waziristan by the Pakistan Army. These announcements came both after months of the government laying siege against the Muslims of Waziristan, by cutting food and other essential supplies, and after Zardari received his orders from America during his extensive visit there. And these announcements coincided with a wave of horrific attacks with dozens of deaths, hundreds of gravely injured, immeasurable grief for the relatives of those affected and an atmosphere of fear and insecurity throughout the country. This violent wave comprised of an attack in a busy market in Peshawar, on 9 October, and then on the headquarters of the army itself, GHQ, in Rawalpindi on 10 October and then on an army convoy at a market crossroads in Shangla on 12 October 2009.

Just as it created confusion and fear before launching the Swat operations to prevent public reaction, Zardari's regime worked tirelessly to exploit the devastating attacks for America's agenda, regardless of who perpetrated these heinous crimes. It used the attacks to attempt to build support for operations in Waziristan, an area that has been the launching pad for significant attacks against the occupying forces of America in Afghanistan, which have bruised their ribs and gripped their hearts with fear.

As for the attacks themselves, we will take care to add here, that those who are well informed of the matters know that American intelligence has infiltrated both some elements from the Taliban, through Pakistan's agencies, and consequently it has infiltrated some elements of the al-Qa'idah organization, many years ago. Indeed, as early as July 2009, America's agent rulers were made aware of an impending attack on GHQ, but did not take the necessary precautions to prevent such an attack. Yet Zardari and his men only leapt into action from their deliberate slumber after the Muslims had begun counting their dead, crying out for the need of operations in Waziristan to please their American masters!

All this is in addition to Zardari strengthening America's physical and disruptive presence in Pakistan, under the guise of expansion of embassies, consulates and bases. America's own intelligence is now able to execute its strategy of bloody unrest throughout Pakistan, just as it has done everywhere from Central America, through the Middle East to South East Asia, whilst the American private military organizations, Dynacorp and Blackwater, whose list of crimes in Iraq is as long as it is brutal, roam the country without restrictions.

And we should know that Zardari and his henchmen provided these invaluable services to America at a most difficult time. America's armed forces are struggling in the hazardous quagmire of Afghanistan that threatens to end their occupation in disgrace. America's political leadership is struggling to find a way to save this failing crusade. Indeed, only within a few months of the US President Obama unveiling a "clear" "Af-Pak" strategy, he is now ruminating over making yet another "clear" strategy! On 16 September 2009, Obama said, "Certainly you don't make determinations about sending your men and women into battle - without having absolute clarity about what the strategy is going to be." But worn-out proposals such as boosting troop numbers, dividing the tribal resistance or tempting Taliban into the political process have been tried before and have only met failure.

So, were it not for Zardari and his men, America would have had no means to stay in Afghanistan as it wishes, faced with a fierce Muslim resistance that has prevented it from settling for over eight years. But thanks to Zardari, the Waziristan operations will now complement America's surge in Afghanistan, effectively surrounding the Muslim resistance. Moreover, Muslims will suffer further losses for the sake of America's security, just as they suffered during the operations in Swat. Muslims will be displaced from their homes, the country will be plunged into insecurity and the largest Muslim army, with hundreds of thousands of God-fearing men willing for martyrdom, will be reduced to a mercenary force to defend the cowardly American military forces from certain humiliation in Afghanistan. And Muslims on both sides will kill Muslims yet again to advance the aims of the kuffar, earning the anger of Allah سبحانه وتعالى. Allah سبحانه وتعالى said,

وَمَنْ يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ خَالِدًا فِيهَا وَغَضِبَ اللَّهُ عَلَيْهِ وَلَعَنَهُ وَأَعَدَّ لَهُ عَذَابًا عَظِيمًا

"And whoever kills a believer intentionally, his Recompense is Hell to abide therein, and the Wrath and the Curse of Allâh are upon him, and a great punishment is prepared for Him." [Surah An-Nisa 4:93]

O Muslims of Pakistan!

For how long will you allow your rulers to use your strength for America's benefit? In the past, America exploited Pakistan's army, rich resources, brave people and ingenuity to help the Afghan Mujahiddeen defeat the Soviet Russians. Later, the US collaborated with Pakistan's elite to support the Taliban to foster stability in Afghanistan and act as a conduit for the transportation oil and gas from Central Asia. Then under Musharraf, it used Pakistan's resources to ensure American military occupation of Afghanistan. مَثَلُ الَّذِينَ اتَّخَذُوا مِنْ دُونِ اللَّهِ أَوْلِيَاءَ كَمَثَلِ الْعَنكَبُوتِ اتَّخَذَتْ بَيْتًا وَإِنَّ أَوْهَنَ الْبُيُوتِ لَبَيْتُ الْعَنْكَبُوتِ لَوْ كَانُوا يَعْلَمُونَ

"The parable of those who seek allies from other than Allah is that of a spider who builds a house; but indeed, the weakest of houses is the spider's house - if they but knew." [Surah Al-Ankaboot 29:41]

The cure for this affliction is one: to remove the treacherous, corrupt Zardari and eradicate the colonialist system that will always bring agent rulers like him, and establish the Islamic Khilafah on its ruins, which will apply Islam, unify the entire Ummah and mobilize all the resources of the Muslims to end all crusader presence in Muslim Lands.

"On the Day when their faces will be turned over in the Fire, they will say: "Oh, would that we had obeyed Allâh and obeyed the Messenger (Muhammad saw)" And they will say: "Our Lord! Verily, we obeyed our chiefs and our great ones, and they misled us from the way." [Surah al-Ahzab 33:66-67]

Remove Zardari now, grant the Nussrah to Hizb ut Tahrir for the establishment of Khilafah, so that you fall under the command of a sincere Khaleefah who will demand that all American intelligence and military leave the region, backing his words with force and deeds, a call which will rally the sincere from amongst the mujahideen, as well as earning the good will of the entire Ummah and the blessings of Allah. Republicans scared of Muslims participating in the American political system

Four House Republicans on Wednesday accused the nation's largest Muslim advocacy group of trying to "infiltrate" Capitol Hill by placing interns in the offices of lawmakers who handle national security issues. The four lawmakers, members of the anti-terror caucus, asked for an investigation into the Council on American Islamic Relations after discovering an internal memo noting the group's strategy. They also highlighted a new book by Paul Sperry titled "Muslim Mafia," scheduled for release on Thursday, which claims the group has been actively infiltrating Congress.Reps. Sue Myrick of North Carolina , Trent Franks of Arizona , Paul Broun of Georgia and John Shadegg of Arizona asked the Internal Revenue Service to determine whether CAIR deserves its nonprofit status. They also are asking their colleagues to review a summary of findings that led the Justice Department to name CAIR as a co-conspirator in a terrorism case. The internal memo, provided to FOXNews.com, stated that CAIR would "focus on influencing congressmen responsible for policy that directly impacts the American Muslim community.”

It appears that American is so paranoid that even when Muslims seek to partake in the American political system they are branded as terrorists.

British banks steal money from its depositors

An increasing number of hard-pressed Scots, struggling with debt repayments, are finding themselves left without money to pay their rent, heat their homes, or even buy food, because their bank is snatching wage and benefit payments from their current accounts without warning. Money Advice Scotland and Citizens Advice Scotland both confirmed to The Herald that they have seen a considerable rise in the number of their clients being left in extreme financial hardship as a result of set-off. This little known practice gives banks the right to take money without warning from a customer’s account if they fall behind with repayments elsewhere within the same banking group, such as those on a credit card or loan account. Yvonne MacDermid, chief executive of Money Advice Scotland , said: “We have seen an increase in this [practice] and I think we will see more of this, especially as banks can’t bring in so much money through [bank] charges etc.” The only way to stop a bank using set-off is to ensure that current account, savings account, credit card and personal loans are all held with separate institutions. The guidance on the Banking Code, to which all UK banks are supposed to adhere, appears to forbid this. It says that banks “should acknowledge that income should only be used to repay ‘non-priority’ debts once provision has been made for any ‘priority’ debts. The subscriber [bank] should leave the customer with sufficient money for reasonable day-to-day expenses”.

Clinton praises Russia for promoting tolerance in Muslim areas

US Secretary of State Hillary Clinton on Wednesday visited Kazan , the capital of Russia 's predominantly Muslim Tatarstan region, lauding it as an example of multi-ethnic tolerance and peace. Over half of the region's population are Tatars, a Muslim Turkic people who live alongside a large ethnic Russian Orthodox Christian population and other minorities. "You are well known as someone who has fostered religious tolerance. It's a wonderful example of what can be done if people work together," she told the local president in the mosque. "I am happy to be here in a place that models interfaith tolerance. So important in the world today," she added. Shaimiyev, who has ruled Tatarstan since the collapse of Communism in 1991, for his part declared that "there are no interfaith problems here. We have plenty of mixed marriages."”A much better way to live," agreed Clinton . In the 15th century, Kazan was the capital of the Kazan Khanate, a Tatar state that was a major Muslim power in the region, before it was sacked by Ivan the Terrible in 1552 and brought under Moscow 's control. Situation in Afghanistan 'desperate': General

The military situation in Afghanistan is "serious" and "desperate," the top Canadian commander in the country, General Jonathan Vance, warned in an interview with CBC television station. "It's a serious, desperate situation. It's a major emergency," he said.

He said it was important to explain the situation to the Afghan and Canadian publics, but not to "sugar coat anything, and it's certainly not to make the mission seem better than it is.But (I)... try and put all of that into some sort of context such that people -- whether they believe we should be here or not -- at least they understand," he said in the 20 minute interview broadcasted on Wednesday.

Militant attack on Pakistani army GHQ foretold

The News International, a local English-language newspaper, had published the details of a report by the interior ministry that an attack on the General Headquarters (GHQ) was imminent. The 5 October report said that fighters from militant outfit Lashkar-e-Jhangvi - with the support of the Taliban in South Waziristan - were planning such an attack.

It said attackers meant to penetrate security by using army uniforms to get into the compound and wreak havoc at the heart of the military's command. "It is simply incredible that the agencies, despite being aware of these facts, could not stop this attack," says Raza, an employee at a local multinational. "If I, as a common citizen, was aware through the news this was going to happen, what does that say about our security services?"

Resetting US relations with Iran

Many have interrupted Obama's recent proclamation to suspend deployment of US missile shield components to Poland and the Czech Republic as proof that finally America is serious about recasting its relations with Russia in a more positive light. However, subsequent statements by members of Obama's administration about future plans for missile defense dubbed ‘phased adaptive approach' are likely to forestall warming of ties between Moscow and Washington.

For instance in a New York Times opinion piece, US Defense Secretary Robert Gates criticized his detractors for describing the new plan as "distorted as some sort of concession to Russia". He further emphasized that the new proposals would bolster European security. "We are strengthening-not scrapping-missile defense in Europe," he wrote.
Away from the public bickering over the effectiveness of the phased adaptive approach, one cannot help but notice that America is most interested in resetting its relations with Iran and not Russia.

New revelations about Iran's diminished missile capabilities now set the stage for the normalization of relations between Tehran and Washington. Downplaying the Iranian threat last month, Robert Gates said, "the intelligence community now assesses that the threat from Iran's short- and medium-range ballistic missiles...is developing more rapidly than previously projected" and "the threat of potential Iranian intercontinental ballistic missiles capabilities has been slower to develop than was estimated in 2006." Gates sudden reassessment follows a familiar pattern frequently employed by US officials to downgrade the peril of Iran's military assets-whenever the situation most demanded it. Previously, under the Bush administration, the National Intelligence Estimate (NIE) revised its estimate from 2010 to 2015 the date by when Iran would possess and atomic bomb.

Additionally, and more significantly, the NIE claimed that Iran had abandoned plans to weaponize its nuclear programme in 2003. NIE claims were a severe below to Israeli plans to attack Iran, and at the time was widely derided by officials of the Jewish State. At the end of last year, America also refused to sell Israel advanced versions of its bunker-busters bombs and downplayed Israel's show of air power over the Mediterranean. On the contrary, America acted in a strange manner-she either watched as a silent spectator or diplomatically mobilized efforts to cool down tensions. The out of character behaviour when measured against the ubiquitous fiery rhetoric that emanated from the corridors of power in Washington suggests to any reader of political events that the two countries are working in cohorts to cement America's hegemony in the region.
America's reliance on Iran to stabilize Afghanistan, Iraq and Lebanon is too precious to be squandered by any crude attempts undertaken by her closest allies to attack Tehran.
The overly inflated threat from Iran's benign nuclear programme by the incessant news coverage has conveniently provided America with the necessary pretext to augment its military ties with Israel and the Gulf countries. Not to mention it also provides America with new avenues to strengthen her missile defense shield abroad and aid nuclear proliferation throughout the Middle East under the guise of peaceful nuclear pacts and in the shadow of nuclear arms reduction talks with Russia. There is little doubt that America will exploit such pacts to ward off competition from Russia, China, and Europe to control cheap Middle Eastern oil.

All of this brings us to the present nuclear talks between Iran and the big six powers. The talks will only conclude, when America is fully satisfied that she can no longer achieve any of her strategic objectives and that her surrogates in Iran have been completely exhausted and are unable to execute her plans. At that juncture, America will settle the nuclear issue and may even allow Iran to keep nuclear weapons in exchange for strict controls.

Study finds Muslim population is 1.57billion
A report from an American think-tank has estimated 1.57 billion Muslims populate the world - with 60% in Asia . The report, by the Pew Forum on Religion and Public Life, took three years to compile, with census data from 232 countries and territories. It showed that 20% of Muslims lived in the Middle East and North Africa . The data also showed that there were more Muslims in Germany than in Lebanon , and more in Russia than in Jordan and Libya together. Senior researcher Brian Grim told CNN that the overall figure was a surprise and said: "Overall, the number is higher than I expected." The report found that more than 300 million Muslims live in countries where Islam was not the majority religion. Of the total Muslim population, 10-13% are Shia Muslims and 87-90% are Sunni Muslims. Most Shias live in Iran , Pakistan , India and Iraq . Europe is home to 38 million Muslims - around 5% of its population with European Muslims making up slightly more than 2% of the world's Muslim population. More than half of the 4.6 million Muslims in the Americas live in the US - however they make up just 0.8% of the population there.

UK soldiers leading life of crime at home
A leading British newspaper reported that more than 20,000 armed services veterans are serving sentences for criminal offences. Shock figures show there are currently 12,000 vets on probation or parole and a further 8,500 in custody. That is twice as many as the number of British troops presently in Afghanistan . The damning statistics were compiled by a nationwide survey of probation officers who say many of the former military personnel were suffering from stress and depression from their service. Harry Fletcher, assistant general secretary of probation officers union Napo , said: "There is overwhelming evidence that there is not enough support for servicemen and women when they return to civilian life. The levels of post traumatic stress disorder and depression are alarming. If these men are brave enough to risk their lives for their country then surely they deserve proper care afterwards.” A survey carried out in 2007 by the group Veterans In Prison concluded that nine per cent of the prison population have served in the forces.

German official slanders Arabs and Turks
A top German central bank official has caused outrage by saying Turkish and Arab immigrants sponge off the state, are incapable of integrating themselves into German society and “constantly produce little girls with headscarves”. Thilo Sarrazin, a former finance minister of the city-state of Berlin who was appointed as a board member of the Bundesbank, Germany ’s central bank, this year made the comments in an interview with Lettre International, a cultural magazine, about Berlin ’s economic problems last week. “A large number of Arabs and Turks in this city, who have increased in number as a result of wrong policies, have no productive function other than the fruit and vegetable trade,” he said. “The Turks are conquering Germany in the same way the Kosovars conquered Kosovo: through a higher birth rate,” he said. “I don’t have to acknowledge anyone who lives off the state, rejects this state, doesn’t properly take care of the education of his children and constantly produces little girls with headscarves,” he said. About 70 per cent of the Turkish and 90 per cent of the Arab population in Berlin were like that, he said. “In addition they have a mentality that is aggressive and atavistic.”

Swiss poster defames Islam
Switzerland 's Commission Against Racism said Wednesday that an anti-minaret poster campaign by a far-right party defamed the country's Muslim minority and could threaten public peace. The Swiss People's Party has unveiled a campaign poster depicting a woman wearing a burka against a background of a Swiss flag upon which several minarets resembling missiles were erected. The commission said, “They suggest that the Muslim minority living in Switzerland represents a danger and send the message that the Muslim population is seeking to dominate the Swiss people, oppress women and disregard fundamental rights.” They “suggest that the Muslim minority living in Switzerland represents a danger” and send the message that the Muslim population is seeking to dominate the Swiss people, oppress women and disregard fundamental rights, it noted.

American soldiers have lost hope in Afghanistan
American soldiers serving in Afghanistan are depressed and deeply disillusioned, according to the chaplains of two US battalions that have spent nine months on the front line in the war against the Taliban. Many feel that they are risking their lives — and that colleagues have died — for a futile mission and an Afghan population that does nothing to help them, the chaplains told The Times in their makeshift chapel on this fortress-like base in a dusty, brown valley southwest of Kabul.“The many soldiers who come to see us have a sense of futility and anger about being here. They are really in a state of depression and despair and just want to get back to their families,” said Captain Jeff Masengale, of the 10th Mountain Division’s 2-87 Infantry Battalion. “They feel they are risking their lives for progress that’s hard to discern,” said Captain Sam Rico, of the Division’s 4-25 Field Artillery Battalion. “They are tired, strained, confused and just want to get through.” The chaplains said that they were speaking out because the men could not.

America to focus its ‘terror war’ on Pakistan
President Obama’s national security team is moving to reframe its war strategy by emphasizing the campaign against Al Qaeda in Pakistan while arguing that the Taliban in Afghanistan does not pose a direct threat to the United States , officials said Wednesday. As Mr. Obama met with advisers for three hours to discuss Pakistan , the White House said he had not decided whether to approve a proposed troop buildup in Afghanistan . But the shift in thinking, outlined by senior administration officials on Wednesday, suggests that the president has been presented with an approach that would not require all of the additional troops that his commanding general in the region has requested. The approach described by administration officials on Wednesday amounted to an all out shift in fighting Al Qaeda in Pakistan .

The Blood of the Muslim is Sacred

The news is unfortunately filled with stories of how Muslims are killing Muslims. Most recently, this has occurred in Somalia, Yemen, Pakistan and also in Palestine. We cannot use violence to resolve disputes with our brothers in the Ummah, as Allah (swt) has made it haram. We must abide by the Shariah when resolving our disputes. Ultimately, we must work to establish the Khilafah and appoint an Amir over us who will implement the justice of Islam. InshAllah, the Khaleefah will be proactive in ensuring our unity and resolving disputes if they are to arise.

The Associated Press reported that fighting between two rival groups in Somalia resulted in the death of 12 people. The article alleges that Al-Shabab and Hizbul Islam fought each other for the control of Kismayo; a port city in Somalia.

The breakout of violence in Somalia, where Muslims are kill-ing Muslims, is part of a disturbing trend that we are witness-ing in the Muslim world. In Pakistan, we have seen the fight-ing of the Pakistani army against the Muslims of Swat. In Yemen, we are seeing the reigniting of the war between the northern tribes and the southern tribes. In Palestine, we also see Muslims from Fatah fighting the Muslims from Hamas.

Killing Muslims is Haram

Allah (swt), in the following ayat, has warned us about the consequences of killing Muslims:

وَمَنْ يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ خَالِدًا فِيهَا وَغَضِبَ اللَّهُ عَلَيْهِ وَلَعَنَهُ وَأَعَدَّ لَهُ عَذَابًا عَظِيمًا
“And whoever kills a believer intentionally, his recom-pense is Hell to abide therein, and the Wrath and the Curse of Allah are upon him, and a great punishment is prepared for him."[TMQ 4:93]

And in the following hadith, RasulAllah (saw) makes it clear that killing and abusing Muslims is haram:
"Abusing the Muslim is an aggression and fighting him is disbelief."[Bukhari and Muslim]

RasulAllah (saw) also warned us of the following:
"When two Muslims face each other in fighting and one kills the other, then both the killer and the killed are in the hell-fire." The Companions asked, "O Messenger of Allah, this is the killer - what about the poor person who has been killed?" The Prophet (saw), said "He had the intention to kill his companion."[Bukhari and Muslim]

Therefore, engaging in a war with a fellow Muslim with the intention of killing him can be the cause of one’s failure on the Day of Judgment. As it is well known, the killing of a soul is a grave sin in Islam. It was narrated that the Messenger of Allah (saw) said:
“The destruction of the world is lighter on Allah than the killing of one Muslim man.”[Tirmidhi]

In situations where Muslims are called out by their leaders (whether group leaders or rulers) to fight one another – they must refrain from doing so; for there is no obedience to the creation in disobedience to the Creator. Instead, they should advise such leaders to end the fitnah and stop fighting one another.
Furthermore, blaming leaders for one’s actions will hold no weight on the Day of Judgment. Allah (swt) has re-vealed:

يَوْمَ تُقَلَّبُ وُجُوهُهُمْ فِي النَّارِ يَقُولُونَ يَا لَيْتَنَا أَطَعْنَا اللَّهَ وَأَطَعْنَا الرَّسُولَا (66) وَقَالُوا رَبَّنَا إِنَّا أَطَعْنَا سَادَتَنَا وَكُبَرَاءَنَا فَأَضَلُّونَا السَّبِيلَا
“On the day when their faces are turned over in the Fire, they shall say, ‘Oh, had we obeyed Allah and obeyed the Messenger’, and they shall say, ‘O our Lord, we obeyed our masters and our great ones and they led us astray from the (right) Way’”[TMQ 33:66-67]

Importance of Brotherhood in Islam

With regards to dealing with each other, we must remember that the most important factor is that we are Muslims. Killing a fellow Muslims must not even by an option in our minds when we are dealing with another. Our brotherhood must transcend any other aspect of our identity. Nationality, group, tribe, or even madhab are all secondary to the fact that we are Muslim. When Prophet Muhammad (saw) was granted authority in Madinah, he established an agreement between the Muslims and Jews. Prophet Muhammad (saw) began the document as follows:

"This is a document from Muhammad the Prophet (saw), governing the relations between the believing Muslims of Quraysh and Yathrib, and those who followed them and joined them and fought alongside them. They are one Ummah to the exclusion of all people."

On the issue of brotherhood, Allah (swt) revealed:
إِنَّمَا الْمُؤْمِنُونَ إِخْوَةٌ
“The believers are nothing else than brothers.”[TMQ 49:10]

With respect to the importance of loving one another, it is narrated that Prophet Muhammad (saw) said:
“By the one in whose hands is my soul! None of you can enter Jannah until you believe and none of you can be-lieve until you love each other for Allah’s sake. Shall I not direct you to something, which if you do it will bring love between you? Do spread the salutations among you.”[Muslim]

Islam’s Method of Resolving Disputes

The root cause of these disputes is due to the absence of the implementation of Islam by a sincere leadership. The justice and security of Islam would prevent many disputes from occurring in the first place. However, if disputes were to arise the sincere Islamic leadership could resolve them in manner that is based on shariah.

Since Islam is a complete way of life, it has a mechanism to resolve disputes, including disputes between the citizens of the Khilafah and the State, between different Islamic opin-ions, and between different groups. Therefore, the only way to ensure peace among the Muslims is to re-establish the Khilafah, which will prevent such haram from occurring and ensure that the disputes of the Muslims are resolved in a manner that pleases Allah (swt).

In the Khilafah, a special court, the Mahkamat ul-Mazalim (Court of Unjust Acts), resolves disputes between the citi-zens and the Khaleefah. For differences of Sharii’ opinions on specific issues, the Khaleefah has the right to bind an opinion upon the Ummah and preserve the unity of the state. For individuals or groups who disagree with one another, a duly appointed judge arbitrates between them, and they are bound by his resolution. Even in the absence of the Khalee-fah, groups that are fighting with one another must abide by the Shariah and resolve their disputes based on the Quran and Sunnah. Whoever rejects the rule of Allah must be pres-sured by all Muslims to accept it. Allah (swt) has revealed:

وَإِنْ طَائِفَتَانِ مِنَ الْمُؤْمِنِينَ اقْتَتَلُوا فَأَصْلِحُوا بَيْنَهُمَا فَإِنْ بَغَتْ إِحْدَاهُمَا عَلَى الْأُخْرَى فَقَاتِلُوا الَّتِي تَبْغِي حَتَّى تَفِيءَ إِلَى أَمْرِ اللَّهِ فَإِنْ فَاءَتْ فَأَصْلِحُوا بَيْنَهُمَا بِالْعَدْلِ وَأَقْسِطُوا إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ
“If two parties among the Believers fall into a quarrel, make ye peace between them: but if one of them trans-gresses beyond bounds against the other then fight ye (all) against the one that transgresses until it complies with the command of Allah; but if it complies then make peace between them with justice and be fair: for Allah loves those who are fair (and just).”[TMQ 49:9]

As for the struggle to re-establish Islam as a way of life, it has to be according to the example of RasulAllah (saw). His methodology did not involve violence. Consequently, one of the top priorities for those who seek change has to be the avoidance of killing or harming Muslims, as this is the way of RasulAllah (saw). As Allah (swt) has revealed:

قُلْ هَذِهِ سَبِيلِي أَدْعُو إِلَى اللَّهِ عَلَى بَصِيرَةٍ أَنَا وَمَنِ اتَّبَعَنِي وَسُبْحَانَ اللَّهِ وَمَا أَنَا مِنَ الْمُشْرِكِينَ
“Say: This is my way: I call to Allah, I and those who fol-low me being certain, and glory be to Allah, and I am not one of the polytheists.”[TMQ 12:108]

The method of the Prophet (saw) to establish the Islamic State was not through military means. Rather, he worked in Makkah to call individuals to Islam and mold them into Is-lamic personalities – people who believed in the Oneness of Allah (swt), would act according to the hukm sharai’ and were motivated by the promise of Jannah. The Prophet (saw) established a group, the Sahabah (ra), that engaged with the society challenging the societal norms, customs and traditions. Within this interaction in society, the Prophet (saw) was ordered by Allah (swt) to seek nusrah and it was with the Ansar that Allah (swt) gave it to him. Since this was RasulAllah (saw)’s method we have no choice but to obey and follow his method.

Divisions in the Ummah: Exploited by the Colonialists

A second dimension to the problem of Muslims fighting Mus-lims is that it makes us susceptible to the domination of the disbelievers. The Europeans and Americans have not forgot-ten the potential of the Ummah. They remember that the Khilafah ruled parts of Europe for centuries and that the Muslims are formidable on the battlefield. Therefore, these nations – America and Europe – will work to ensure that the Ummah stays weak. They will work to disunite the Ummah in whatever way they can. This was prophesized by Prophet Muhammad (saw):

“The nations are on the verge of summoning each other over you, as the eaters summon each other over their large bowl. So a speaker said: Is it due to our small number on that day? He said: No, rather that day you will be many, but you will be foam like the foam of the torrent.”[Abu Dawud].

Therefore, we must be aware that the non-Muslim nations will take advantage of the divisions amongst us and use them to gain domination over us. And this is exactly what happened during the colonial era. The Western nations in-vaded Muslim lands in order to impose kufr (Capitalism), to subjugate the people and plunder their resources. This tactic of “divide and conquer” was described by T.E. Lawrence (a.k.a. “Lawrence of Arabia”) as follows: “If we can only ar-range that his (Sherif Hussein; who led some Arab tribes in betrayal against the Uthmani Khilafahl) political change shall be a violent one, we will have abolished the threat of Islam, by dividing it against itself in its very heart. There will be a Khalifa in Turkey and a Khalifa in Arabia, in theological war-fare, and Islam will be as little formidable as the Papacy when Popes lived in Avignon.” This policy culminated in the signing of the Sykes-Picot treaty, which divided the Muslim lands amongst the British and the French. This treaty and other Western actions have led to the tragic situation today where the Muslims are divided into 50+ states, which had previously been united under one Khilafah.

After World War II, the Americans took over where the Euro-peans left off. Today, America is unsatisfied with the map drawn by the Europeans and it intends to further break up the Muslim lands. The American plan to divide the Muslim lands was laid out in an article published in the Armed Forces Journal in 2006 [1], which divided Iraq, Turkey, Paki-stan, Saudi Arabia, and other Muslim countries into even smaller and weaker states. And we are seeing this plan come to fruition – not just in Iraq, but also now in Pakistan. Further-more, the influential American think tank, RAND, openly at-tacks the concept of Ummah as being a disease calling it “umma-itis". In another report authored by Cheryl Benard, (wife of Zalmay Khalilzad, Bush’s Ambassador to Iraq) RAND has no shame in publicizing its “divide and conquer” strategy, stating: “Support the traditionalists against the fundamentalists: Discourage alliances between tradi-tionalists and fundamentalists”.

As Muslims, we must be aware of these plots – the disbe-lievers are so brazen as to openly declare them!

How can we knowingly disobey Allah (swt) and fall into their traps?May Allah (swt) help us to re-establish the Khilafah, so that we may have a just ruler who will unite us and settle our dis-putes in a manner that pleases Allah (swt).

إِنَّ أَكْرَمَكُمْ عِنْدَ اللَّهِ أَتْقَاكُمْ
"Verily the most honoured of you in the sight of Allah is he who is the most righteous of you."[TMQ 49:13].


Chapter 5:The Conditions of Legal Responsibility [Shurūt al-Taklīf]

The following is the draft english translation from the Usul Al-Fiqh masterpiece of the Arabic book الشخصية الاسلاميَة الجزء الثالث (The Islamic Personality Volume 3 ) by Sheikh Taqiuddin an-Nabhani. Please refer to the original Arabic for accurate meanings.

Islam (being Muslim) is not a condition for legal responsibility [taklīf] with respect to the legal rulings, except for a ruling about which a text specifies that it is for Muslims, either explicitly [sarahatan], like,

«يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ»
“O you who believe, fear Allah…” [al-Imrān: 102], and

«جَاهِدِ الْكُفَّارَ»
“Strive against the disbelievers…” [at-Taubah: 73]; and

«وَلَنْ يَجْعَلَ اللَّهُ لِلْكَافِرِينَ عَلَى الْمُؤْمِنِينَ سَبِيلًا»
“And Allah will never allow the disbelievers to have authority over the believers” [an-Nisa’: 141];

or by denotation [dalalatan], like the exemption of the kuffar from something, like the salāt, thereby indicating that Islam is a condition in that act. Therefore Islam is one of the conditions of legal responsibility in that which it comes as a condition.

However there are more general conditions of legal responsibility, in which there is no distinction between Muslim or kāfir. These conditions are physical maturity [bulūgh], sanity or a sane intellect [‘aql], and ability [qudrah]. Thus for a person to be legally responsible he must be physically mature, sane, and able to perform what he has been made responsible with. From Ali (may Allah ennoble his face) that the Messenger of Allah (saw) said, “The pen is lifted from three: the sleeping one until he wakes up, the insane until he regains his sanity, and the child until he matures”, narrated by Imam Zayd in his Musnad. And Allah, the Exalted, says,

«لَا يُكَلِّفُ اللَّهُ نَفْسًا إِلَّا وُسْعَهَا»
“Allah burdens not a soul beyond its ability…” [al-Baqarah: 286]

The meaning of ‘lifting of the pen’ is ‘lifting of the responsibility’ such that one is not legally responsible nor addressed by the legal rulings, and the meaning of “Allah burdens not…”, although a negation, contains the meaning of prohibition, and this is supported by his (saw) saying, “and if I command you with a matter fulfill it as much as you are able”, narrated by al-Bukhāri and Muslim. It should not be said here that Allah has obliged the zakāt, provision [nafaqah], and liabilities [damanāt] upon the child and the insane and so therefore they are legally responsible [mukallaf] because they have been made responsible for some of the legal rulings. This is not correct because these obligations are not connected to the act of the child or the insane, rather they are connected to their wealth and liability [dhimmah].
Their wealth and liability are the subject of responsibility, not the child or insane themselves.

This is clear by the fact that the lifting of the pen is specified by a clear limit, “until he becomes mature”, and “until he becomes sane”, and this benefits the derivation of an effective cause [`illah], which is the physical immaturity, and the insanity, and these have no relevance to money and debt, hence they are not an exception to the rule. Nor should it be said that Allah, the Exalted, has made him who has no ability to fulfill a matter responsible with the fulfillment of that matter, as He commanded Abu Lahab to believe in what was revealed, whilst He (swt) informed that he will not believe, so He brought together two contradictory matters, thereby assigning responsibility of the impossible, that is, He made a person responsible for that which he cannot do. This is incorrect because Allah first made Abu Lahab responsible to believe in what He (swt) had revealed, and did not at that stage reveal that Abu Lahab will not believe. Only after this did Allah (swt) inform that he will not believe.

Thus His (swt) informing that Abu Lahab will not believe did not come with His being made responsible with the belief, because the informing came after the evidence establishing the obligation of belief. This is in terms of the original conditions of legal responsibility with respect to the legal rulings. As for the lifting of the legal rulings from the one made responsible for them, these are not conditions of legal responsibility, rather they are reasons which make permissible the leaving of the ruling.

These are like the one who is coerced, the one who makes a mistake, and the one who forgets; these matters (coercion, error, forgetfulness) lift the blame [haraj] of non-fulfillment from those made responsible for the relevant legal ruling. This is not a case of these people not being responsible in the first instance, hence these matters are not of the conditions of legal responsibility.

The Messenger (saw) said, “Allah has removed from [wada’a ‘an] my Ummah mistakes, forgetfulness, and that which one is coerced upon”, narrated by Ibn Majah.

Notice the difference between his (saw) saying, “The pen is lifted…”, and his saying, “removed from my Ummah”, such that the former refers to the lifting of legal responsibility, such that one is not originally responsible, whilst the latter refers to the removal of accountability from the Ummah, and it does not necessitate the lifting of the legal responsibility.The legally-considered coercion is the coercion which forces an act to be performed in a manner that one could not leave it, and if it does not force the act in this manner it is not considered. Thus if the coercion reaches the level of necessity [idtirar] then one is not accountable for the act.

However if it does not reach level of necessity, then one still has the option of abstaining, so he is accountable.

Is Europe about to be overrun by Muslims?
A number of prominent European, American politicians and journalists seem to think so. The historian Niall Ferguson has predicted that “a youthful Muslim society to the south and east of the Mediterranean is poised to colonize a senescent Europe ”. And according to Christopher Caldwell, an American columnist with the Financial Times, Muslims are already “conquering Europe ’s cities, street by street”. So what if Muslims account for only 3 percent to 4 percent of the EU’s total population of 493 million? In his book Reflections on the Revolution in Europe: Can Europe Be the Same With Different People in It? - Caldwell writes: “Of course minorities can shape countries. Another worry is the growing Muslim population in Europe . Caldwell claims in his book, “have a long track record of underestimating their vulnerability to ‘primitive’ ones”. As the London Daily Telegraph, quoting Caldwell, asserted last weekend, Britain and the EU have simply ignored the “demographic time bomb” in their midst. Caldwell is convinced that

“Muslim culture is unusually full of messages laying out the practical advantages of procreation.” Many Western thinkers are advocating radical measures to deal with this problem. Bruce Bawer, whose book While Europe Slept: How Radical Islam Is Destroying the West from Within suggests that European officials, who are “in a position to deport planeloads of people everyday”, “could start rescuing Europe tomorrow”.

So much for tolerant Europe — the harbinger of freedom and pluralism. Clearly when it comes to Muslims both at home and abroad, their ideals give way to demagoguery and bigotry. How can Europe claim to possess values that are universally applicable?

UK pushing for an attack on Iran
This week MI6 intelligence Chief Sir John Scarlett has been told that Saudi Arabia is ready to allow Israel to bomb Iran ’s new nuclear site. The head of MI6 discussed the issue in London with Mossad chief Meir Dagan and Saudi officials after British intelligence officers helped to uncover the plant, in the side of a mountain near the ancient city of Qom . The site is seen as a major threat by Tel Aviv and Riyadh . Details of the talks emerged after John Bolton, America ’s former UN ambassador, told a meeting of intelligence analysts that “ Riyadh certainly approves” of Israel ’s use of Saudi airspace. Foreign Secretary David Miliband acknowledged that the danger of a nuclear arms race in the Middle East was “particularly potent” and refused to rule out military action altogether but he insisted: “We are 100 per cent focused on a diplomatic solution.” Gordon Brown, US President Barack Obama and French President Nicolas Sarkozy have warned Iran ’s leader Mahmoud Ahmadinejad that he must allow in weapons inspectors or face more sanctions.
Contrary to public perception it is Britain and not the US that is pushing for a strike on Iran . America concessions over the past year or so, and its efforts to resume dialogue with Iran have angered Israel . Britain seeks to exploit this anger and instigate an attack on Iran ’s nuclear plants.

Saudi praises Obama’s peace overtures towards Muslims
Underscoring the widening reach of interfaith dialogue, a senior Saudi official praised the US president Barack Obama yesterday for infusing discussions among the faithful of various religions with new vigour. On the opening day of a two-day interfaith conference Abdullah al Turki, the secretary general of the Mecca-based Muslim World League, said the US leader had “contributed in creating an atmosphere of more understanding between the followers of religions and cultures through bridges of dialogue”. The tribute to Mr Obama appeared to be a reciprocal gesture, for in his prepared remarks, Mr al Turki noted that the US leader, in his June speech to the Muslim world in Cairo , had singled out Saudi Arabia ’s King Abdullah for undertaking his interfaith initiative. The conference, notably taking place in the heart of Protestant Christian Europe, is the fourth such meeting sponsored by Saudi Arabia and comes a week after King Abdullah dedicated a sprawling, state-of-the-art university for science and technology in the desert 80km from.

Afghanistan: Tensions between EU and US lead expulsion of UN official
As American troops move deeper into southern A senior United Nations official has been removed from his post after rowing with his superior and the Afghan government about how to deal with the fraud-riddled election. Peter Galbraith, the number two UN official in the country, agreed to temporarily leave Afghanistan earlier this month after a dispute with Kai Eide, the organisation's senior diplomat in Afghanistan . The American diplomat, who is a close friend of US envoy Richard Holbrooke, had angered the Afghan government by demanding a wholesale recount of votes in a heated meeting with electoral officials. State-owned Afghan newspapers went on to attack Mr Galbraith for interfering in Afghan affairs leaving Mr Ban to decide his position was untenable. The split between the top two in the UN Afghan mission has mirrored deep divisions in between the US and EU on over how to deal with an election mired in fraud.

US threatens to expand its war inside Pakistan
This week the US has told Pakistan that it may start launching drone attacks against the Taliban leadership in the city of Quetta in a major escalation of its operations in the country. The US State department and intelligence officials delivered the ultimatum to Asif Ali Zardari, Pakistan 's president, last week as he visited the US for the United Nations' Security Council sessions and the G20 economic summit. US Ambassador to Pakistan Anne W Patterson has said, amid reports that Washington may start drone attacks on Balochistan’s capital. “In the past, we focused on Al-Qaeda because they were a threat to us. The Quetta Shura mattered less to us because we had no troops in the region,” Ambassador Patterson was quoted as saying in the course of a dispatch in The Washington Post, which says that Taliban insurgents have a haven in Pakistan .
“Now our troops are there on the other side of the border, and the Quetta Shura is high on Washington ’s list,” she said.

The Prophetic method of da'wah to Allah

The following is an Urdu article published in an Urdu Daily newspaper in Hyderabad, India. It is written by one of the activists working for the return of the Khilafah, the scholar - graduate of Dar al Uloom Deoband, Mufti Habeeb ur-Rahman Qasmi.
