Understanding the concept of Dharoorah (“necessity”) in Fiqh As Muslims, we know that our actions should be guided by the dictates that Allah (سبحان و تعالى) has placed for us, but among the many monkeys on our backs that we find it “difficult” to shake off in modern times are contemporary social strictures, pressures and conventions that can often make it challenging to practice even the most basic obligations. گزشتہ  6 ماہ سے ملک بھر میں اسلامی معاشرتی نظام کے   قوانین پر  پابندی عائد کرنا بحث کا   موضوع بنا ہوا ہے اور اس پر  تبادلہ خیال کیا جا رہا ہے - خواتین کے چند گروپوں نے مثلا   "بھارتیہ مسلم مہیلا آندولن" وغیرہ نے  سپریم کورٹ میں عرضی دائر کی ہے کہ    تین طلاق کے ذریعہ فوری طلاق  پر   پابندی عائد کی جائے کیونکہ یہ   غیرآئینی، امتیازی اور اسلامی قانون کے خلاف ہے - ان  کا کہنا ہے کہ ایسے موقعہ پر  عورتوں کو  اپنے دفاع  کی یا طلاق پر اعتراض کرنے کی اجازت نہیں  ہوتی ہےجس کی وجہ سے   اچانک انہیں بے یار و مددگار چھوڑ دیا جاتا ہے اور ایسے معاملے میں  نہ ان کا خاندان ان عورتوں کا ساتھ دیتا ہے اور نہ ہی سماج ان کےحق کے لئے کھڑا ہوتا ہے - ان کا یہ بھی االزام ہے کہ تین طلاق سے   طلاق کے قرآنی احکام کی خلاف ورزی ہوتی ہے، اس کی کوئی مذہبی حیثیت نہیں - لہذا اس پر  قانونی طور پر پابندی لگا دینی چاہیے۔ اس نئے مقدمے کے بعد ہندوستان کی سپریم کورٹ نے  اسلام کے معاشرتی قوانین کوجانچنے  کا فیصلہ کیا ہے کہ وہ ہندوستانی  آئین کی شرائط پر کھڑے ہیں یا نہیں - اور اس بات کا بھی  اندازہ  لگائے گی

UNCOVERING THE 'BAN ON TRIPLE TALAQ' CONTROVERSY IN INDIA

For over 6 months now the subject of banning Islamic Laws of the Social system has been discussed and debated across the Nation. Certain women groups such as the BMMA (Bhartiya Muslim Mahina Aandolan) and others have petitioned the Indian Supreme Court to ban ‘triple talaq ’ as a means of instant divorce, arguing that it is unconstitutional, discriminatory and contrary to Islamic law. They have reasoned that women are not allowed to respond or object to the talaq , and are often left vulnerable after being suddenly abandoned and shunned by both family and the wider community whilst the men receive no repercussions.   They also claim that the triple talaq violates Quranic injunctions on divorce, that it has no place theologically and should be banned legally.
