Q&A: Is Debt a Legitimate form of Ownership?

Question: Our beloved Shaykh, the scholar ‘Ata’ Al-Khayr, Assalamu Alaikum wa Rahmatullah wa Barakatuhu, question: It has been mentioned in the book,  The Economic System of Islam , [p. 76 Arabic edition/ p.70 English edition], that the means of possession are limited to 5 they are: work, inheritance, obtaining of funds for the sustenance of life, the State granting of its funds to the citizens, funds that the individuals take without exchange of funds or work. But we were confused over another type, is it a means of possessing funds or a means of fund development, which is debt, and to explain the confusion I will post the following example which happens among the people: suppose a man does not possess any wealth, took a debt of 1000 dinars from someone, then bought merchandise from the market and sold it, and gained 500 dinars profit, and after receiving the profit and the capital money, he returned the debt to its owner and 500 dinars of profit stayed with him, so was what ha...

The New Middle-Eastern Map and Sectarian, Madhabiy and Nationalist Lines

There are three vital political objectives that stand out in the current Ummah’s reality and these are: the liberation from foreign dominance and control, political unity and the application of Islam. These are connected and intertwined objectives and they are all realised through the realisation of the Islamic project represented in the Khilafah upon the methodology of the Prophethood and it is this which will make the Muslims one Ummah as many of the Shar’iyah texts have affirmed from which is the Noble Aayah: إِنَّ هَذِهِ أُمَّتُكُمْ أُمَّةً وَاحِدَةً وَأَنَا رَبُّكُمْ فَاعْبُدُونِ “Verily this Ummah of yours is one Ummah and I am your Lord so worship me” (Al-Anbiyaa 92) As for the division of the Islamic lands and dividing the Muslims upon political, sectarian and ethnic lines then this represents the project which is the complete opposite to the Khilafah. And so at the beginning of the last century this arose as a result of the colonial project implemented...

Q&A: “The Mutawatir Sunnah of Action”

Question: As-Salaam Alaikum Wa  Rahmatullah Wa Barakaatuhu I have two questions please, May Allah grant you success 1-In the book  The Islamic Personality (ash-Shakhsiyah)  Volume 3 (page 82, Arabic version) the following was mentioned: “The Mutawatir Hadeeth is a definite text from the Prophet ﷺ, it is definite and therefore must be implemented in everything whether in Sunnah of action, speech, or consent. From the Mutawatir Sunnah of speech is the Hadeeth of the Prophet ﷺ: «مَن كَذَب عليّ متعمداً فليتبوأ مقعده من النار» “Whoever intentionally transmits falsely from me, he has reserved his seat in hellfire” And from the Mutawatir Sunnah of Action is the five prayers and their number of Rak’as, and what is mentioned regarding the method of prayer, fasting, and Haj The question is: what is ‘the Mutawatir Sunnah of Action’? Is it the Tawtur (recurrence of narrations) of actions carried out by the Prophet ﷺ? Or is it the recurrence of narrations of actions...

Q&A: The Sale of Gold

Question: Assalaamu Alaikum Wa Rahmatullahi Wa Barakaatuhu, as you are aware my honourable brother an ‘Ajal’ (delay) is not valid with the sale of gold because it is hand to hand – this for that- as has been mentioned in the Hadeeth… Does this apply to jewelry? The reality that this question applies to is the following: The gold that is sold as jewelry is from the 18-carat calibre and not the 24-carat calibre… The 24-carat calibre is pure gold reaching 99.9% which makes it hard to mould. As for the 18-carat then this represents 75% gold whilst the remainder is made up of metals such as copper and iron which makes it susceptible to being moulded and shaped. Actually, it is possible to colour the gold according to the metal that has been added. Then at the time of the sale of this jewelry the jeweler adds the cost of the moulding on top of the price of the gold based upon its weight. Would the jewelry in this case then be considered like any other commodity which has gold in...

Q&A: Latest Political Developments in Uzbekistan

Question: Recently on 27/08/2015 the American Assistant Secretary of State for the Affairs of Central Asia visited Uzbekistan. A month prior to that on 27/07/2015 the Chief of the United States Central Command of the Armed Forces visited Uzbekistan whilst more than a month before that on 12/06/2015 the General Secretary of the UN visited Uzbekistan… Are these successive visits an evidence of the consolidation and assuredness in respect to the strength of the American-Uzbek relations or an evidence of weakness and absence of assuredness which has lead America to intensify these visits in order to strengthen the relationship out of fear that Russia will exploit this weakness and increase its influence in Uzbekistan? This is part of the question and the second part is related to the tyrant’s daughter and Russia. After it was publicised that she would inherit her father’s rule, the rule of the tyrant was then extended once again whilst she is being kept under house arrest. Does that mea...
