Q&A Ustaadh Ahmad Al-Qasas in regards to how the Muslim rulers should be described

بسم الله الرحمن الرحيم Question: Assalaamu Alaikum Ustaadh Ahmad, I would be grateful if you could answer my question: In the case where Allah (swt) has negated the Imaan of the one who does not rule by the Shar’a of Allah, what then is the description of our rulers? Are they Murtaddeen (apostates) or Munaafiqeen (hypocrites)? Answer: Wa Alaikumus Salaam Wa Rahmatullah, The ‘Ulamaa have differed in regards to their judgement upon the rulers who do not rule by what Allah (swt) has revealed. Some of them said he is a Kaafir Mutlaaqan (absolutely) whilst the majority have stated that the judgement differs case by case. So if he rules by other than what Allah has revealed and declares that this is the correct manner of ruling and the truth whilst stating that the Shar’a of Allah is not suitable for ruling or that Allah (swt) has not legislated a Shar’a for us to be ruled by i.e. he is a disbeliever in the Shar’a., then in this case he would be a Kaafir (disbeliver). Is Hizb ut Tahrir capable of establishing the Islamic State in Lebanon? If yes, then how will it do so? And if no, then what is the significance and importance of the political activities of the Hizb in Lebanon which are related to the call to build an Islamic Khilafah? The answer: Indeed Lebanon is not suitable or viable to be any kind of State, whether Islamic or otherwise. This is because it is a failed state in all meanings of the term and its history is the greatest witness upon this fact. It is mentioned in the book, The Funds in the Khilafah State (Al-Amwal), on the subject of fines, page 104 (English edition), "Similarly, a fine is taken from the abstainer of paying Zakat half of his wealth as chastisement above the Zakat obliged upon him, due to the Prophet صلى الله عليه وسلم saying: «وَمَنْ مَنَعَهَا فأنا آخذها وشطر ماله» "....Whoever prevented it then I will take it plus half of his wealth"  (narrated by Abu Dawood and Ahmad). Question & Answer: Participation in Kufr Systems Question: While researching the prohibition for a Muslim to participate in a Kufr system which does not rule by Islam, someone said that they heard one of the scholars allowing this participation citing Yusuf (as) ruling by the laws (shariyah) of the king of Egypt... Also that the Negus remained for many years ruling by Kufr even though he was a Muslim and the Prophet (saw) prayed Janazah prayer  in absentia for him. And that benefit (Maslaha) which is a Shariyah evidence requires so (i.e. participation). A Muslim in ruling (hukm) will cater to the interests of Muslims more than a secularist.
