About the obligation for the Qat’iy Daleel to be fulfilled in respect to the I’tiqaad

About the obligation for the Qat’iy Daleel to be fulfilled in respect to the I’tiqaad (belief i.e. Aqeedah) in the branches (Furoo’) and the Usool and the statement of Al-Imaam An-Nawawi (rh) From the archives: Al-Imaam An-Nawawi said: ‘The Usool of the Deen is obligatory to have I’tiqaad in by way of the Tawaatur. As for the Furoo’ (branches) then it is not obligatory for the Tawaatur to be fulfilled (in respect to them)’. This statement of An-Nawawi is not a Shar’iy Daleel; it is not valid to use it as evidence at all and so it is not permitted to present it as a Daleel (evidence) for the permission of Al-I’tiqaad (belief) in the branches without the Tawaatur being fulfilled (in respect to them). This is because it would represent deduction of a Hukm Shar’iy by other than the Adillah Ash-Shar’iyah (Islamic sources of evidence i.e. the Kitaab, Sunnah etc...) in the case where the speech of An-Nawawi is not from the Adillah Ash-Shar’iyah or from the Adillah Al-Aqliyyah (rationa

Q&A: Land of Sawad of Iraq; What is obliged on the Kaffir in the Ushriyia Land

Question: Assalaam Alaikum wa Rahmatullah wa Barakatahu May Allah grant you His forgiveness and good health, I have two questions, the first one: It is known that Omar Ibn Al-Khattab (ra) kept the land of Iraq and refused to distribute it to the fighters, the question is: Is this an Ijtihad of Omar Ibn Al-khattab (ra) which others may hold a different Shariah opinion, or is it a consensus of the companions which is prohibited to differ with? The second question is: land in the Islamic state is either classified as a Kharaj or ‘Ushr. Kharaj as defined in the book  Funds in the Khilafah State  as: the right of the Muslims imposed on the land that is conquered from the Kuffar, either by the use of force or by peaceful means, it would thus be a Kharaj of force and a Kharaj of peace. And ‘Ushr is what is taken from the produce of ’Ushri land of a Muslim and it is Zakat and is given for specific categories decided by the Shar’. The question is: in a land where its inhabitants

Q&A: Zakat on Secured Currency; The Lands which the Islamic State Lays its Hands on

Question: Assalamu alaikum wa rahmatullah wa barakatuhu my dear respected brother. I became confused on two matters for which I would like you to please clarify them, may Allah سبحانه وتعالى reward you with all good and help you. The first matter is related to the Zakat on secured paper currency. It is mentioned in the book  “Funds in the Khilafah State”  that the representative paper currency is treated the same as gold or silver because it represents either gold or silver. This is clear. It is also mentioned that Zakat on compulsory paper currency is obligatory because it is linked to the currency  ‘Illah,  and its value is evaluated with gold or silver depending on its purchase value in the market and its Zakat is calculated after the  Nisab  and the passing of one year. This is also clear. As for the “reliable paper currency” which has a specific cover of gold and silver according to a specific proportion which is less than the nominal value of currency as determined by the St

Political deception: Its reality and its effect upon the Ummah

Political deception: Its reality and its effect upon the Ummah Hasan Hamdan 25/03/15 The means and styles utilised by the disbelievers in their war against the Muslims have varied since they dealt a decisive blow against their political entity: ‘The Khilafah’. They killed that tender mother leaving her sons afflicted by a great loss and so they lost their political caretaker. Then in order to prevent the Muslims from being able to restore the authority of Islaam and to stop the return of its State the disbelievers found themselves in the greatest need of deceiving and misdirecting the Muslims. This was so that they would not tread the correct path which would lead to change and so the West utilised a wide range of political means and styles to prevent the return of Islaam. Political deception represents the most dangerous of these means. The reality of political deception is to conceal the political truth (or its true reality), to blot it out and make others blind to it by makin

Cow slaughter ban in India- milking of the Democracy loophole

The Maharashtra state Animal Preservation (Amendment) Act came into force from March 4, 2015 with the President giving his sanction to it. It extends a previous ban on cow slaughter to bulls and bullocks too, those caught violating the law face a five-year jail term and a fine of Rs 10,000 (160 $), if convicted.  This ban has rendered thousands of Muslims jobless, loss of revenue to the tune of Rs.100 Billion (1.6 Billion USD) and even zoo animals being fed the low energy chicken instead of beef.    Moving ahead, Consider the following scenario - You are at work; kids in school. Someone rings your doorbell. Your wife opens the door and the person barges in. He dashes to your fridge and scrambles through the freezer box and drops the contents to the floor. He finds red meat (perhaps mutton?), deems it beef and books you! If that’s not eccentric enough, the onus is on you to prove that the meat is not beef! It’s effectively- “guilty until proven innocent”. We are referring he
